Emery at 775 Sixth avenue. When You Turn On Gas Heater, Light It, Mr. McNutt HOLLYWOOD, Oct. 17. -Patterson McNutt, film writer, was chilly in his studio office today, and turned a gas heater on full blast after closing all the windows.

His secretary, Miss Katherine O'Brien, smelled gas. She found him unconscious and hurriedly called J. P. McEvoy and Howard J. Green, writers.

McNutt was treated at a studio hospital. McNutt explained: "I thought it was a steam heater. It sizzled like the one in my New York apartment. But somehow the effect wasn't the same." Miss O'Brien took him to task: "If you want to commit suicide, use a gun-I just hate the smell of gas." Fifteen Stories, One Clings To Life by a Hand NEW YORK, Oct. a fellow worker plunged to his death today on the sidewalk 150 feet below a broken scaffold, Perry Fast, 21, grabbed a rope and hung by one hand until he was rescued.

The man who died was Joseph Alampi. at The two were working at the fifteenth floor level of an apartment building when one end of their precarious perch gave way. Fast, with a 60-pound bucket of water-proofing material in one hand, clung to a rope with the other. Maurice Bauman, who lives in the apartment outside which the two men were working, hooked a loop of rope around Fast's feet. Fast let go and hung head down, while Bauman yelled for help.

Michael Spinelli, who had witnessed the accident from his over and helped Bauman pull window across street, ran the, Fast through the window. Lindy's Blacklist Assertion Denied WASHINGTON, Oct. Post Office Department today denied that it had "black listed" officials of air transport companies whose air mail contracts were annulled last winter on the grounds of collusion. In a statement replying to the testimony yesterday by Colonel Charles A. Lindbergh before the Federal Aviation Commission, Harlee Branch, second assistant postmaster general, disputed Lindbergh's assertion that the air transport officials had been given no opportunity to prove whether they had been guilty of wrongdoing in previous air mail contract lettings.

Forced Jobless Have Vote Right, Asserts Roosevelt WASHINGTON, Oct. -President Roosevelt said today under no possible honest conception of the law could a man out of work and willing to work be regarded as a pauper and be denied the privilege of voting. Informed at his press conference that action had been taken in twelve states to deny the vote to persons on relief, the President said he believed no court in the land would classify, the person willing to work AS pauper. DIES IN PARIS Had Made Residence in French Capital, for Several Years; Leaves Widow, 2 Children Benno Hart, former San Francisco socialite and capitalist, died of a heart attack in a Paris hotel yesterday morning, dispatches said. had made his residence in Paris for several years. Surviving are his widow, Sarah, and two children, Benno Hart Jr.

and Mrs. Constance Hart Faure. both of whom figured in sensational divorce court proceedings in the past six years. In 1930, the former Genevieve Mills, after a year of marriage to Benno filed suit for divorce against him in the Paris courts, naming her mother-in-law as the disturbing influence. Mrs.

Faure was divorced from C. Ellsworth Wylie of San Francisco, after court hearings that were attended by startling charges and counter-charges. DR. ERNEST MARTIN. Dr.

Ernest Gale Martin, head of the department of physiology at Stanford University, died at his Palo Alto home of pneumonia last night. Dr. Martin, who was 57, was distinguished in the fields of physiology and biology, and had served on several important Federal health committees. He was a native of Minneapolis. Surviving are his widow, two brothers, Prof.

Arthur W. Martin of Tacoma and Prof. James R. Martin of Boston University, and a sister, Mrs. Emma Barnes of Oakland.

LUKE HAMILTON. Luke Hamilton, 83, former San Francisco hotel man, died yesterday Oakland, at his home, 330 Euclid avenue, illness. following a year's A native of Nova Scotia, Hamilton first came hero 60 years ago. Later, he migrated to the Mother Lode, three country children, in 1900. Mrs.

Tenant Denied Bail In Rent Murder CLOVIS (N. Oct. Wolfenbarger, 54, who shot and killed C. A. Massengill, 70, after an argument over $28 rent, was arraigned today on a charge of murder and jailed to await preliminary hearing.

Bail was denied. The landlord had attached and removed Wolfenbarger's furniture, but a court had ordered him to restore it. Girl Exposes Her Tongue in Court And It Costs $13 CLEVELAND, Oct. -Mrs. Lillian Mack smiled today when she was fined $5 and costs, suspended, in Police Court on a disturbance charge.

Elated over the court's decision, she turned to Detective Peter Merylo, who arrested her, and stuck out her tongue at him. The judge saw the gesture, and said promptly, "Mrs. Mack will have to pay the costs." The costs amounted to $13.35. Neighbors smelled the gas and police found Edward Myatt, 38, credit manager for a large Mission street jewelry concern. Rit- Grange Leader Hits Crop Destruction SALINAS. Oct. 17. Raymond McKaig of Boise, Idaho, past master of the North Dakota Grange, in an address before the State Grange convention, today attacked forced destroying of crops.
