trust law is uncou-ktltutional. The decision of Judge Lucas was Riven in a $100,000 civil action brought by J. A. Harvey owner of a Santa Cruz theater, under the terms of the Cartwright act. Harvey contended that Frank Macauley.

Louis Greenfield and Mveral other persons had "entered a conspiracy" preventing Harvey from obtaining fllmB to show in his theater. OWNERS. Macauley and Greenfield are theater owners in Santa Cruz, and the other defendants are film exchange officials. Attorney Schmulowltz represented all the defendants except Macauley. Following oral argument of the ult Schmulowltz submitted his b-ief, asking dismissal of the case.

He argued that the Cartwright Act, somewhat similar to the Sherman ntl-trust law, was unconstitutional In that it does not permit "due process of law," to which all Citizens are entitled. Specifically, Schmulowitz contended the act lacks "due procesH of law" in that it fixes no standard of jruilt and gives the right to com piainant of either criminal or civil recovery. SAME CASE IN COLORADO. He pointed out that the United States Supreme Court, in a recent decision by Chief Justice Taft, declared the Colorado anti-trust act unconstitutional The Coioraoo act is a replica of the Cartwright act, declared the attorney. Attorneys for Harvey declared they would probably appeal Judge Lucas' decision.

The Cartwright act has never been appealed to either the State Supreme Court of the United States Supreme Court nd appeal of the decision as a "test case" would welcomed by-many attorneys in California, it was declared. LADIES OF THE GRAND ARMY, are requested to attend the funeral of our One of the largest liquor raids ever made in Northern California occurred yesterday when three federal prohibition sgents swooped down on a large two-story house at 9703 Scott street, Oakland. They found the houts packed from basement to second floor with whisky and wines. Four truck loads of assorted whiskies and liquors, valued at $100,000, were seized. Tn house contained 250 cases of champagne, bearing the labels of various foreign, wineries. In the basement of the house were scores of vats, barrels and kegs containing every conceivable kind of wine.

It was impossible to estimate the value of the wine. Included in the seizure were several book, containing names of wealthy East Bay residents, restaurants and cafes. Prohibition agents believe these to have been order books and believe the names are those of customers. The names will be investigated. One arrest was made, of a man found in the house at the time of the raid.
