C.N.R. church warden of the parish of St. Maxime de Scott, Beauce county, which developed out of a dispute with Abbe Emile Bernard, the parish priest. The statement given out over the Cardinal's tignature explains some of the facts, which it says have been published inexactly in some quarters. The statement follows: "Certain newspapers have published versions of the court case against Abbe Bernard, rector of the parish of Saint Maxime de Scott, Beauce county, which have been inexact and suggestive.

Father Day was born at New York city in 1873 and attended Notre Dame University, Boston University and finished his theological course at the Grand Seminary, Ottawa. He was ordained at the Basilica In 1916 and that year was appointed curate at Almonte, under Mgr. Cavanagh.

The following year he founded the church at Darling, and was appointed parish priest there. Five years later Father Day was made parish priest at Cantley, and from there was appointed to Assumption church on August 6th last. The remains will leave the rectory, 60 Russell road, this afternoon at four o'clock for the Basilica, where they will lie in state. Solemn requiem high mass will be chanted Saturday morning at nine o'clock. The body will leave Ottawa at 3 p.m.

Saturday for Boston, where interment will take place. Father Day was taken ill early yesterday morning and Dr. T. T. Dufour was called.

An Eloquent Speaker. An eloquent speaker from the pulpit, Father Day was noted for his sermons and members of other parishes often went to service in Assumption church to hear his addresses to the congregation. He was also noted In the parishes where he had been priest for. his financial ability and no matter how deeply in debt a church was when he took it over, under his leadership the parish began to come from behind and when he left his several charges they all had balances on hand and were free from debt. In Assumption church the financial situation was considerably Improved In the short time that he had been parish priest it was stated by parishioners last evening.

While hsaring a case in the Superior Court, to which he had been elevated only about four months ago, Mr. Justice L. J. Arthur Brossard, 62, died suddenly here today. Appointed to the Bench on August 30, 1933, to replace Hon.

Mr. Justice Charles Archer, retired. Judge Brossard had been sitting regularly ever since and gave no sign of ill health. Born in the town of Lapralrle, in 1871, Judge Brossard graduated In law from the University ol Montreal. Called to the bar In 1896, he was created a King's Counsellor a few years later.

In the course of his legal career he appeared In many outstanding cases both civil and criminal. Judge Brossard introduced Premier R. B. Bennett to his first Quebec audience at a gathering of 10,000 In Lapralrle. udge Brossard contested the Laprairie-Naplerville riding once but was defeated.

He Is survived by his wife, one son, Femand Brossard, and two daughters, Mrs. Charle E. Letour-neau, and Mrs. Andrew Beaubicn. Can.
