Sutherland, a case arising from stock transactions in Toronto. Suther- land, the respondent, directed a broker, rarit to buy tor him a certain quantity of Federal Bank stock, and paid him a margin of 10 per cent, on the value, fieing about to go to England he arranged with Farley for a "time loan" on this stock, agreeing to pay tier cent. During his absence Farley retired from the brokerage business and transferred all his sttKik transactions, including that with Sutheilaud, to the appellants, Cox Worts, who wrote to Sutherland's agent acknowledging having received the stock from Farley. On Sutherland's return he heard that Cox A Worts were "short" on Federal Bank stock ami oalleil on Cox for information, and alleges that he told Cox that he.w ished to sell, but was advised not to tlo so, and informed that if he did he would have to pay interest to the date cf the expiration of the time loan, and ho refrained from selling to save that interest. Sub-seouently the stock fell and was sold by Cox Worts, ho made a statement showing that it realized less than their claim cm it.

Sutherland then brought an action for loss jirotits, and Cox having leen examined, the statement of claim wits amended by alleging that the stock was not Isiught according to instructions, and claiming a return of the amounts paid for margins, etc. On the trial it was shown that no stock was purchased by Farley or transferred by him to the appellants, but it was claimed that by the usual practice among brokers the stock was treated as bank notes, and the broker merely held himself liable to procure the stock whenever required to tlo so. The Chief of Ontario, who tried the case gave judgment for the defendants (Cox Worts), but his Judgment was reversed by the Divisional Court on the ground that this practice had the effect of substituting the personal liability of the broker for the real security of the stock ami could not lie upheld in law. The Court of Appeal alii lined this decision. At the conclusion of the argument for the appellants yesterday the court gave judgment, dismissing the appeal on substantially the same grounds as those relied on in the court below. Mr. W. CaRsels, (4) appeared as counsel for the appellants, and Mr.
