Last April Ihe owner of Ihe burned out gasoline station on (he corner of Houle 69 and Summit Road applied to MVD for a renewal of his previous license. The renewal was granted and the owner then applied to the town building inspector for a permit to renova te the site.

The permit was denied on the grounds lhal the MVD renewal license was issued in error. In the opinion of the building inspector the owner's application should not have been treated as a renewal because two and one-half years had elapsed since Ihe previous license had been in effect. Sabo said the town's position is that the application should have been considered a new application by MVD thus requiring a public hearing and approval by the Prospecl Zoning Board of Appeals before MVD could issue a license. Such hearing or approval has not been applied for by the owner. In a recent legal action brought by the owner against the Prospect Planning and Zoning Commission lo force the issuance of Ihe eleclrical permit, Ihe town's position was upheld by the court.

The Planning and Zoning Commission has informed Mayor Sabo thai to invalidate the MVD license the town will now be required lo exercise its right of appeal as provided for in the applicable stale Statute. A decision as to whether or not this action win be made pending further review of the situation by the Planning and Zoning Commission and Ihe Zoning Board ol Appeals.
