250 Bank St. Q. 945 AUTOMOBILES. Ton Truck 1928 MODEL Charges Courtesy Lack to Bench and Counsel Mr. Doctor Successfully Objects to Client's Action.

Lack of courtesy to the bench and counsel was alleged by M. Doctor, solicitor, in police court today his charge being based on a most unusual development in a case for selling on Sunday. Frank Imbrogno, 415 Rideau street, on May 30 was charged with selling a cigar on Sunday. He and a number of other storekeepers were represented by M. Doctor, as counsel, and pleas of not guilty were entered.

Mr. Doctor raised the point that under the consolidated statutes of Upper Canada, under which the charge was laid, the offence had to be proven against the person actually selling on Sunday and that it was not sufficient to prove that the sale took place in a certain store. Under the Lord's Day Act, it is provided that the owner of a store shall be liable for the act of his employe. In the Imbrogno case the prosecution could not say who actually sold the cigar. The argument was heard by Magistrate Hopewell and the case was adjourned until today.

Meanwhile Imbrogno called at the police station, entered a plea of guilty and paid the fine of $10 and $2 costs. Magistrate William Joynt who was on the bench today, agreed with Mr. Doctor that counsel should have been consulted and the case left over to the date to which it had been ad journed, He authorized the return of the fine and the cancellation of the plea of guilty. The Imbrogno case and a number of others in which Mr. Doctor is counsel were adjourned until next Wednesday when Magistrate Hopewell will be on the bench.

Policeman's Suspicions Correct in This Cas When Police Constable Edgar Kedey became suspicious on seeing William Bernard, of Montreal, in the Provincial Bank building, 125 Rldeau street, he made investigations and found Bernard had liquor not purchased from an Ontario government vendor. In police court Bernard pleaded guilty to trespassing and was fined $1 and 12 costs. On the charge of a breach of the Liquor Control Act he also pleaded guilty and was fined $100 and $2 costs or three months in Jail.
