Police say Heatley was driving his Ferrari about 80 mph on a narrow Atlanta street when he wrecked Monday night.

Snyder was a passenger. Heatley faces a felony charge of serious injury by vehicle and three misdemeanor charges. Police are awaiting test results to determine if Heatley was drinking on the night of the wreck. Caps' Nylander breaks leg ODENTON, Md. BOXING Tyson loses tax ruling COLUMBUS, Ohio Mike Tyson is not entitled to a refund of $5.8 million in state income taxes he paid in 1995-96 when he owned a home near Cleveland, tax authorities ruled.

Tyson bought the 62-acre estate in Southington in 1991 and lived there until going to prison in 1992 after a rape conviction. He paid $2 million in state income taxes to Ohio in 1995 and $3.8 million in 1996, his tax returns said. He claimed he moved to Nevada after leaving prison and mistakenly paid the Ohio taxes. The Ohio Department of Taxation argued that even though a person can have more than one residence, the person must have a primary home, and in Tyson's case it was Ohio. COMPILED BY DEAN BAILEY FROM WIRE REPORTS HORSE RACING Mineshaft retired, won't run in Classic LOUISVILLE, Ky.

Leading Horse of the Year contender Mineshaft was retired Friday because of a minor ankle injury and won't run in the Breeders' Cup Classic. Trainer Neil Howard said racing's newest star has a chipped bone in his right front ankle, an ailing right knee and a bone chip developing in his left ankle. Mineshaft, owned by William S. Farish, will stand at Farish's Lane's End Farm near Versailles, and will command a $100,000 stud fee. Rather than risk serious injury, the decision was made to end Mineshaft's career one race early the colt was scheduled to be retired after the BC Classic.

With a command performance in winning the Jockey Club Gold Cup at Belmont last week, Mineshaft became the front-runner for Horse of the Year honors. Even without running in the BC Classic at Santa Anita on Oct. 25, the colt remains the top contender over the likes of Medaglia d'Oro and Perfect Drift. PRO FOOTBALL Frerotte to start again EDEN PRAIRIE, Minn. Vikings quarterback Gus Frerotte will make his second straight start Sunday, replacing injured Daunte Culpepper when undefeated Minnesota visits Atlanta.

The Vikings (4-0) have a bye the following weekend, which will give their star quarterback more time to heal after breaking three small bones another was partially broken in his lower back Sept. 21 against Detroit. Frerotte, who played college football at Tulsa, threw four touchdown passes in a victory last week over San Francisco that resulted in a near-perfect 157.2 quarterback rating. Frerotte (128.2) and Culpepper (108.0) are the top two rated passers in the NFC. PRO BASKETBALL Mavs waive Gregoire DALLAS The Dallas Mavericks waived Rod Gregoire, a forward who has played in China, Mexico, Brazil and England.

Hawks sign ex-Spur ATLANTA Free-agent swingman Stephen Jackson signed with the Atlanta Hawks. Jackson, who can play small forward and shooting guard, will join practice Monday and is expected to compete for a starting job. Terms of his contract weren't disclosed.

The 6-foot-8 Jackson helped the San Antonio Spurs win the NBA title last season. He ranked third on the team in playoff scoring at 12.8 points per game. HOCKEY Heatley facing surgery ATLANTA Already facing felony charges for a high-speed crash that left a teammate in a coma, Atlanta Thrashers All-Star Dany Heatley learned that TODAY IN OKLAHOMA By The Associated Press WOODSTOCK, Ga. Baked greens and thick rough were troubling enough Friday at the American Express Championship. Even more daunting was Tiger Woods pulling away from a world-class field without breaking a sweat.

In one of his best rounds of a roller-coaster year, Woods made seven birdies and finished with a 4-under 66 to take a five-stroke lead into the weekend at Capital City Club. He not only had the best score of the day only four other players broke par Woods was eight strokes lower than the course average. "It's awfully nice to be in front," said Woods, who was at 7-under 133. He hasn't been in that position at any time during a tournament since going wire-to-wire at the Western Open in early July, which is also the last time he won. Woods is 19-4 when having at least a share of the 36-hole lead.

The challenge falls to Rocco Mediate, Tim Herron, Sergio Garcia and K.J. Choi, who all gave up shots on the tough Cra-bapple course and were at 138. The other players under par were Stuart Appleby (68) and Ig-nacio Garrido (71), who were at 139. Vijay Singh had his second even-par 70 and was at 140. Huston up by 2 MADISON, Miss.

John Huston shot his second straight 66 and held a two-stroke lead after two rounds of the Southern Farm Bureau Classic. Huston began the day in a three-way tie for the lead and ended it at 12-under 132 after two trips around the course at Annandale Golf Club. First-round co-leader Hidemi-chi Tanaka was second at 134. He started his round with a double bogey on No. 10, but rebounded with five birdies on the back nine for a 68.

Tim Clark and Chris Anderson matched Huston's low round of 66 and were tied for third at 135. Pak moves ahead LINCOLN, Calif. Se Ri Pak shot an 8-under 64 and held a one-stroke lead over Sophie Gustafson after two rounds of the LPGA Longs Drugs Challenge. Pak had one eagle and seven birdies in setting a tournament record with a 9-under 135 total at Lincoln Hills Club. Gustafson had three birdies in a 2-under 70 that followed her opening 66.

Jamie Hullett (69), Suzann Pettersen (70), Wendy Ward (71) and Michelle Ellis (72) were tied for third at 139. WOMEN'S COLLEGE GOLF Oklahoma State at Chapel Hill, N.C., in Tar Heel Invitational, All Day CONTACTS TRANSACTIONS By Steve Brisendine AP Sports Writer KANSAS CITY, Kan. Jim-mie Johnson broke the track qualifying record Friday at Kansas Speedway to take the pole for Sunday's Banquet 400. Winston Cup points leader Matt Kenseth continued his recent struggles and had to rely on a provisional starting position for a second straight week. Johnson's quick lap of 180.373 mph in a Chevrolet broke the year-old mark of 177.924 mph by Dale Earnhardt Jr. The lap around the lVPmile tri-oval gave Johnson his second pole of the season.

Seventeen other drivers also broke that record, aided by cool temperatures that hovered in the mid-60s all afternoon. "A couple of things led to the faster times," said Johnson, who has won three times this year but lost his engine and finished 34th last week at Talladega Superspeedway. "The colder weather was one, and all these teams are working harder and harder to find speed." When they do, Johnson said, NASCAR will find a way to slow them down. "It's just a constant game of cat and mouse," he said. "It's just finding somewhere new to look.

They are tightening up the bodies so much more on us for next year that we're probably going to start off the year a little slower." Kenseth, who leads Kevin Harvick by 354 points and Earnhardt by 384, crashed in practice and turned in a disappointing lap of 175.547 in qualifying.
