ORDINANCE NO. 1108 An Ordinance GRANTING A VARIATION FROM THE MOUNT PROSPECT ZONING ORDINANCE WHEREAS, The Board of Appeals has heretofore, on September 24, 1965, conducted a public hearing on a request by Salvatore Di Mucci for a variation from the Mount Prospect Zoning Ordinance to permit the construction of a water tank and pumping station on property hereafter described located in the R-A Single-Family District in Mount Prospect, Illinois; and WHEREAS, notice of public hearing was given in the manner provided oy law; and WHEREAS, the construction of a water tank and pumping station is required at said location to provide adequate water supplies and fire protection for residents of the i a of Mount Prospect; and WHEREAS, The Board of Appeals of the Village of Mount Prospect has recommended that the variation sought by the petitioner be granted; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PROSPECT, ILLINOIS: SECTION ONE: That a variation from the zoning ordinance of the Village of Mount Prospect is hereby granted to Salvatore Di Mucci Sr.

to permit the construction of a water tank and pumping station on premises located in Unit No. 7 of Elk Ridge Villa, which premises are more particularly described as, The North 80.0 feet of the South 646.0 feet of the West 160.0 feet of Lot 5 in the Division of the Louis F. Busse Farm, being the Northeast Quarter except the West 686.40 feet of the Northwest Quarter of said Northeast Quarter of Section 15, Township 41 North, Range 11 East of the Third Principal i i a Cook County, Illinois. SECTION TWO: That the Superintendent of Building of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variation hereinabove granted upon application therefor. SECTION THREE: That the variation granted by this Ordinance shall become null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variation is made a construction commenced within one year from the date this said Ordinance becomes effective.

SECTION FOUR: This ordinance shall be in full force and effect from and after its passage and approval and publication in the manner provided by law. Notice of Public Hearing PUBLIC NOTICE IS HEREBY given that the corporate authorities of the City of Rolling Meadows will hold a public hearing on a proposed annexation agreement between Ernst Seegers and Eleanor Seegers, his wife; American National Bank and Trust Company of Chicago, As Trustee under Trust No. 20369, and the City of Rolling a on December 14, 1965, at 8:00 o'clock p.m. in the meeting room of the Bank of Rolling Meadows. The said agreement provides for the annexation and zoning of the following legally described property to M-l, Manufacturing District and to R-6, Multiple Family District pursuant to the Zoning Ordinance of the City of Rolling Meadows.

It shall be unlawful for any person, firm, or corporation to store, sell or offer for sale in any building or structure, or on any open or vacant lot or parcel, within the Village any pine, balsam, fir. or any other trees, or any branches or parts thereof.

which have been cut for use as Christmas trees or for ornamental or decorative purposes, without first having obtained a license as herein provided. Section 14-2802 License fee. The fee for such license shall be Fifteen Dollars ($15.00) per year for each location at which such tree, or branches or parts thereof, are stored, sold or offered for sale. Section 14-2803 Safety. No person, firm or corporation shall operate or maintain any business for which a license is required by this Article XXV- III of Chapter 14 unless the location thereof has been inspected and approved by the fire chief or his duly authorized deputy to determine that the conduct of such business at such location will not constitute a fire hazard or endanger the safety of the public.

Section 14-2804 Location. No license shall be issued for any business required to licensed by this Article XXV- III of Chapter 14 unless the Zoning Ordinance of the Village of Arlington Heights permits the conduct of such business at such location. Section 14-2805 Sanitary Regulations. Premises used for the sale of Christmas trees, or branches or parts thereof, shall be cleared and all trees. branches and parts thereof removed from the said premises on or before December 31 of the year for which the license is issued.

Section 14-2806 Bond. No license shall be issued for any business for which a license is required by this Article XXVIII of. Chapter 14 unless the licensee shall have deposited with the Director of Finance of the Village a cash bond in the amount of Fifty Dollars ($50.00) for each location for which a license is issued. Such bond shall be held by the Director of Finance for the purpose of securing the prompt and orderly removal of Christmas trees and branches and parts thereof from the said premises on or before December 31 of each year. Such bond shall be refunded to the licensee upon surrender of the receipt thereof within five (5) days after the discontinuance or termination of the said business, together with satisfactory evidence that all trees, branches and parts thereof have been removed from the premises and that the premises have been left in a clean and orderly condition.

Section 14-2807 Penalty. Any person, firm or corporation violating any of the provisions of this Article XXVIII of Chapter 14 shall be fined not less than i Dollars ($15.00) nor more than Five Hundred Dollars ($500.00) for each offense, and a separate offense shall be determined to have been committed each day during which or in which the violation occurs or continues. SECTION THREE: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law PASSED APPROVED this 16th day of November, 1965.
