THE DAILY OKLAHOMAN Thursday, January 5, 1995 11 From Jail, Alleged Kidnapper Says Boy Safe in Foreign Land torney Ed Kumieg; but Floyd claims the charges have been dismissed because he was using a plastic gun. Assistant U.S. At- so has been filed against him. Five weapons-possession charges were filed in Oklahoma County, with kidnapping Michael Hughes and Indian Meridian Principal Davis. A federal kidnapping charge al said he couia neitne confirm nor deny i the charges have beei dropped.

Davis to a tree and left in Davis' truck. The truck later was recovered near Dallas. After Michael Hughes was taken from the school, Floyd said he took the boy to the foreign country. Floyd said he then returned to the United States alone to obtain a passport and other identification. Upon his return to the foreign country, Floyd said he planned to marry a woman and obtain citizenship for himself and Michael.

But before he received the necessary papers, Floyd said he was arrested in Louisville, Ky. At one time, a national search for Michael Hughes was centered on the Atlanta area. But a local FBI spokesman said recently the search there yielded no clues to the boy's whereabouts. Floyd has been charged in Oklahoma County District Court Hughes gave birth to another son and daughter, Floyd said. Both were adopted by other families.

Tonya Hughes was working as a stripper in a Tulsa bar at the time Floyd convinced her to marry him so he could care for Michael if something happened to her. Floyd said he had nothing to do with Tonya Hughes' death, but police have said he is the only suspect. "I would never hurt my son, and they can't never prove it," he said. Floyd also said the gun allegedly used in the abduction from the elementary school was plastic. When Michael was taken from Indian Meridian Elementary School, Principal James Davis was also taken.

The kidnapper told Davis to drive his truck to a secluded area about two miles from the school. The kidnapper handcuffed By Lisa Beckloff Staff Writer Franklin Delano Floyd said 6-year-old Michael Anthony Hughes is safe in another country. He admitted taking the boy from a Choctaw elementary school in September, but on Wednesday said his action is not kidnapping because Michael is his son. He added Michael is staying with a longtime friend in a country he would not identify. "Unless this thing is humanized in some fashion and people look at this in the real light of what happened, that little boy is going to be stranded in a foreign country all of his life," Floyd said.

"And I'm going to die in the penitentiary, and justice ain't gonna never be done." Floyd talked to The Oklahoman during a telephone interview from the Oklahoma County Jail. When Tonya Hughes was a young girl, Floyd said she was "abandoned to him." He could not allow her to be placed in an orphanage, so he raised her as his daughter.

Floyd said he kept her in school through the years, but she had problems, with relationships with boys. Before giving birth to Michael, Tonya Michael Anthony Hughes abuse against Michael Hughes. Michael was illegally taken from him, Floyd said, because he had never harmed the child in any way. He said state officials are not allowed to remove a child from home unless evidence of abuse is found. "I love my son with all my heart and soul," said Floyd, 51.

Floyd said he was lawfully married to the boy's mother, Tonya Dawn Hughes, who was killed in a hit-and-run accident in 1990.
