By Gene Spagnoli The first step toward sewer scandal to the grand jury The move was disclosed Queens Assistant District Attorney Edward Markowitz slapped a subpoena on Victor Clemente, Queens contractor, at the office of Investigation Commissioner James Sheils at 50 Pine St. Clemente is the uncle of Representative L. Gary Clemente, Queens Democrat, who is a former City Councilman. The contractor was hit with the subpoena after he had spent two hours being questioned by Sheils, with Markowitz sitting in. Does this mean you are ready to present the case to the grand jury? Markowitz was asked.

"We'll have to question him 15-Minute 'Death' Kills Memory of Marriage Baldwin Park, Aug. 23 (U.P.).- -A Navy veteran whose heart was massaged back into action after it had stopped beating for 15 minutes was unable to understand today that his wife had sued him for' divorce. Melvin E. Hewitt, 28, could not even remember that he had been married. Mrs.

Mabel Werrett, Hewitt's mother, said that her son's surgical experience had left him in a world of childhood recollections. He has no memory of recent events, including his marriage to Delores, 21, El Monte, Calif. They were estranged before his close brush with death last October. Mrs. Werrett said her son was served with papers in his wife's divorce action yesterday, but he did not understand what they meant.

Mrs. Hewitt charged mental cruelty and habitual intemperance, and asked for custody of their 2-year-old daughter, Lucinda. Mrs. Werrett said Hewitt, who left a hospital only recently, reads newspapers and magazines, but remembers things for only a few and James Desmond presenting the growing Queens was taken yesterday. first," said the assistant DA.

He added that the announcement on the next step would come from District Attorney T. Vincent Quinn. Victor Clemente was one of five witnesses questioned by Sheils yesterday in an all-day probe into a $187,000 sewer project in Laurelton, Queens, built by Clemente's firm. An inspection tour by top city officials, headed by Mayor Impellitteri, disclosed Friday that the Laurelton sewer is riddled with contract violations, leaks like 8' sieve and is causing sidewalks to buckle. Besides Clemente the witnesses were the contractor's son, Dominick, 24, and three Queens sewer inspectors.

The names of the inspectors were not revealed, but it had been previously disclosed that they have been relieved of inspection duties and assigned to clerical work since the sewer scandal broke. Lundy Withholds Names. Sheils said he could not give out the names because Queens Borough President James Lundy, who has been investigating sewer projects since last April, has not seen fit to make them public. It would be discourteous, Sheils said, for him to infringe on Lundy's right to make the announcement. Sheils showed the same concern for the courtesies of the situation in discussing his findings yesterday.

He was continuing the investigation, he said, and would report at the proper time to the proper persons. He said that Clemente had been questioned in detail about how the Laurelton sewer job was bossed. "We may need him later and may have him back here," the city's corruption watchdog added. The Investigation Commissioner said that the probe was assuming wider scope and "other contractors may be called." But he refused to be more specific. "He loves to play the harmonica," she said.

"That is one of the few things he has remembered." Hewitt fell outside an El Monte bar last Oct. 2 and was knocked' unconscious. Taken to a clinic, doctors pronounced him dead. A surgeon cut open his chest, however, and massaged his heart until it started beating again. He was in a coma for a month, and doctors warned then that the lack of blood flowing to his brain during the time that his heart was stopped might cause permanent damage to the brain.
