Stone appeared in Supreme Court yesterday for application of an order enjoining "Books on Trial" from broadcasting, claiming that the program was inspired by "Author Meets the Critics." The hearing was set for Wednesday morning before Judge Morris Eder. Until lust week, Stone's show had been a popular feature on WHN for several years. It begins a new schedule over WQXR Thursday night at 9:30. To these ears, "Books on Trial" presents a rather interesting approach to literary criticism over the air, handling a normally academic subject in entertaining fashion. The format is a switch on "Author Meets the Critics." But what program doesn't copy from another? Last night's session featured a "courtroom trial" of William Bradford Huie and his "The Case Against the Admirals." Sterling North acted as presiding judge, with Fetcher Pratt as prosecutor and Tex Mc-Crary as defending attorney.

Most of the retiring applicants said they wished to wait until the outcome of the controversy of color versus black-and-white telecasting and the possibility of the transfer of channels to higher frequencies. Others were concerned about costs; transmitter and equipment running $250,000 upwards; also operational expenses which could be as much as annually without much prospect of a quick return. The question of receivers also was a factor.
