The Pocono Reord, The Stroudsburgs, Po. May 7, 1976 Pittsburgh Mayor won't seek re-election Mayor Pete Flaherty Shapp informally endorses Carter HARRISBURG I -Gov. Milton J. Shapp said Thursday Jimmy Carter would beat both President Gerald Ford and Ronald Reagan together if the presidential election were held now. Shapp still won't give Carter his formal endorsement.

He claims it would serve no purpose at this stage. But he told reporters he would work actively for Carter if he wins the a i i i a nomination. "I think at the present time Carter could probably beat them both together, particularly if they are both in the same room," Shapp said when he was asked to assess Carter's presidential chances against Ford or Reagan, "I have no reservations about 'supporting Carter. I'd be glad to support him." Then the governor said his remarks "are already an endorsement of Carter," but not a formal one. He said he hopes to talk with Carter next week.

Shapp held a brief news conference to answer questions before he left Pennsylvania for a weekend in Ireland at the expense of the Irish government, which has invited several governors to take a tour. He also commented on i a Flaherty's decision not to seek another term next year, which would clear the way for a Flaherty gubernatorial bid in 1978. "He would be'a strong candidate," Shapp said. "He must be reckoned with as a gubernatorial candidate if he decides to run in 1978. But I believe Lt.

Gov. (Ernest) Kline is the most likely candidate." Shapp talked briefly about the a a Volkswagen to locate its first American plant in a former Chrysler Motors building near New Stanton in western Pennsylvania, but he refused to release details of the negotiations. "We will be in constant contact with Volkswagen officials in Germany," Shapp said. "We should know their decision by next week some time." Shapp admitted that a site in Cleveland has more natural advantages than the New Stanton site, but he said the Pennsylvania site is still in the running. "Eight years is enough fur any man. I shall not seek reelection for a third term as mayor of Pittsburgh," said Flaherty at a surpise press conference. Flaherty, 50, refused, however, to rule out a possible bid for the governorship in 1978, or a spot in the cabinet of Jimmy Carter should the former Georgia governor be elected president. "I hope to keep my options open," he said. Flaherty said he had not discussed a post with Carter, hut would continue to be "very active" in his campaign.

Flaherty was the only major state politician to endorse Carter in the April 27 Pennsylvania primary which Carter won. Flaherty bucked the city Democratic organization to be elected mayor in 1669, and in the 1973 primary, won the Democrtic and Republican nominations on the way to overwhelming re-election. Flaherty was frustrated in his 1974 bid against Sen. Richard Schweiker to become the i candidate from Western Pennsylvania since 1952 to win a U.S. Senate seat.

If he were elected governor, Flaherty would follow in the a i Lawrence, Pittsburgh mayor from 1946 to 1959 who was elected governor in 1959. In his time, Lawrence was considered undisputed party boss in the state. At a Harrisburg press conference later in the day, Gov. Milton J. Shapp said Flaherty would make a good candidate for governor in two years, but said he believed Lt.

Gov. Ernest Kline was the front- Woman sues Philly cops for calling her 'nuts' PHILADELPHIA (UPI) An elderly Philadelphia woman is suing five policemen for calling her "nuts," handcuffing her and driving her to a local hospital after she asked them to remove juveniles loitering outside her home. Cleo Smith, 78, a widow, Wednesday also named the city as a defendant in her damage suit in U.S. District Court. "I like to feel that a policeman is an honorable man, and that he is here to protect me," she said at a news conference, "not to treat me animal." Mrs.

Smith said she called police to her north Philadelphia home the morning of last Aug. 12 to have them remove two youths who were sitting on her doorsteps. She claimed that when the oficers arrived, they walked up to her and said, "Go in the house and shut your mouth. "I didn't think that was right," she said. So, Mrs.

Smith called the police again and a sergeant arrived. The sergeant said he could do nothing about the youths and left. She again telephoned police and the sergeant returned to her house with four other officers. Mrs. Smith said the sergeant told her she would be taken to Philadelphia General Hospital.

"I asked them why," she said, "and he said they were going to take me to the psychiatirc ward because 'you're She said she never had been treated for a mental disorder. According to the woman, police handcuffed her--until she finally persuaded the officers to remove them--and took her to Philadelphia General Hospital. Mrs. Smith said she was suing "because 1 couldn't believe things like this could happen in America." Police refused comment on the case. runner at this lime.

Flaherty is credited with keeping Pittsburgh fiscally sound. He is also popular for not raising property taxes as mayor, and keeping the city payroll trim. Critics, however, claim his skimpy budget has caused a decline in essential services. Flaherty has had constant battles i i a policemen, who say they are undermanned. "He is very tight fiscally," said one observer.

"He doesn't spend money for anything if he can help it." Flaherty predicted a first- ballot victory for Carter at the Democlraic convention in New York in July and said he believed "Jimmy Carter will be the next president." "I think he's in a non-lose situation. The 'Keytsone State' turned it around for him," Flaherty said. Noting that Assistant U.S. Attorney General Richard Thornburgh, a Republican "is also keeping his options open," and could be an opponent in a race for the governorship, Flaherty said: "You can't tell what will happen in politics."
