Gen. Kent Frizzell fulfilled today his promise to file a test case to determine the validity of a provision of the. 1969 motor fuel tax and freeway law. The attorney general filed in Shawnee County District Court a suit that, in effect, asks the court to support his earlier opinion that -a provision prescribing a priority index formula for the construction of freeways is so contradictory that it is useless. Meanwhile, the Highway Commission decided Wednesday to go ahead and draw up a priority list for building freeways.

Frizzell asked the court: I. to declare the provision for the priority index formula to be invalid; 2. to declare that all other sections of the act are valid; 3. to restrain the Highway Commission from using the priority index formula written by the legislature. Though technically a defendant in the suit, the Highway Commission would prefer to use its own oE methods for determining priorities.

DA VIES (C) New York Times FAIRBANKS, Alaska A University of Alaska research economist startled a science conference Wednesday by asserting that Alaska might be shortchanged billions of dollars in bids from oil companies in a land lease sale next month. The economist, Gregg Erickson, estimated the net worth of about 400,000 acres on Alaska's North Slope being offered for lease Sept. 10 at S2 to S4 billion. Petroleum industry sources have suggested bidding at the sale might yield Alaska around $1 billion. Erickson suggested the sale be postponed for 6 months to permit the Alaska legislature to revise the state's oil leasing policy.
