Larry will take and bury him." Angiulo: problem." Walter E. Bennett, 55, of Dorchester has been missing since 1967 and presumed by police to have been a murder victim.

His brothen, William F. Bennett. 56, of Mattapan was shot and killed and thrown out of a car in Dorchester the same year. Francis P. Salemme is listed as an unindicted coconspirator in the racketeering indictment against Angiulo, Zannino and five others.

The case is scheduled for trial June 11, Angiulo: Zannino: "The state of California can take it now. The statute is murder Angiulo: "Don't give me that, will Zannino: "Don't give you what? With all the information they have before the grand jury." Angiulo and Zannino continued discussing legal requirements necessary for the federal government to gain jurisdiction of the Barboza case. But Travaline argued that proof of a motive is not evidence of a conspiracy to kill.

Barboza shot to death Barboza, formerly of New Bedford, was a strong-arm enforcer for loansharks and was the admitted killer of 26 persons. After two of his friends were murdered, Barboza became a government witness and testified against Angiulo in a murder case in 1968. Barboza was shot to death In San Francisco eight years later. In a transcript of a Feb. 12, 1981, conversation that the FBI taped at Angiulo's North End office, he and Zannino discussed whether a grand jury had returned a secret indictment in the Barboza killing.

The transcript reads In part: Angiullo: "They ain't got no secret indictment." Zannino: "But it's not out of the way." Angiulo: "What do you mean one? If they got an indictment for you and me, it's all over. I don't believe that. I will tell you there might be a secret indictment for one guy. That's what I want to know. I don't want to know about you and I.

We're sitting here." Zannino: "Yeah." Later in the conversation, Angiulo and Zannino talked about the possibility of an indictment against Joseph (JR) Russo. Angiulo: "Nobody in the world could ever indict J.R. for murder. Stop, will you please?" Zannino: "Wait a minute. An-giulo and Ilario M.A. Zannino talked about the murder of gang-fend informer Joseph Barboza and the prospect of their own indictment, according to transcripts of conversations taped by the FBI and filed in US District Court in Boston. The transcripts the first of more than 250 hours of FBI An-giulo tapes to be made public -were submitted by Angiulo's lawyer, Joseph T. Travaline, in support of a motion to dismiss three of the racketeering allegations against his client. Angiulo, 64, of Nahant, and Zannino, 63, of Swampscott, were arrested along with five other alleged organized crime figures by FBI agents last September after a federal grand jury indicted them.

Racketeering charges listed in the 20-count indictment include six murders, two planned murders, Ioansharking, illegal gambling, threatening witnesses and "fixing" a bookie case in Roxbury District Court. T. Angiulo has been held without bail since his arrest. The others are free on high bail. The indictment alleges the defendants comprise the Hierarchy of the Boston branch of La Cosa Nostra crime family.

The case of the Bennett brothers Travaline claims the tapes dis close there was insufficient evidence presented to the grand jury to support Angiulo's alleged involvement in a conspiracy to murder Barboza in 1976, and two brothers, William and Walter Bennett, in 1967. In the motion, Travaline claimed that the sole evidence submitted to the grand jury regarding Angiulo's alleged involvement in the Bennett murders was a tape of a March 12, 1981, conversation between Angiulo and Zannino. That tape does not implicate Angiulo, the lawyer said. Another tape relating to the Barboza murder does not implicate Angiulo either, Travaline said. Excerpts from the tape transcripts, contained in a sealed affidavit submitted by FBI agent Edward M.

Quinn. buttress the defense position, Travaline claimed. The lawyer said the FBI affidar vit quotes Zannino explaining to two of his alleged soldiers that he had recommended the promotion of Joseph Russo (also know as J.R.) to capo regime (lieutenant) in the organization. The indictment alleges Russo shot and killed Barboza in California. The Quinn affidavit quotes Zannino as saying Russo "was a very brilliant guy, who stepped right out with a carbine We clipped Barboza.
