John Degnan said was the first indictment alleging the existence of a nationwide organized crime family, known in Italian as "Cosa Nostra." A 24-count indictment alleged that the group, which Degnan referred to in its English translation, "This Thing of Ours," is comprised of the Genovese crime family in New York and other families throughout the United States. The term "Cosa Nostra" has long been used by government investigators to refer to links among Mafia members in this country.

Degnan said members of the secret organization conspired to murder, extort funds and run a loansharking business. "We are prepared to demonstrate, in the course of proving the other charges contained in this indictment, the existence of organized crime in the United States," he said. The indictment charged the eight conspired "to enter into a continuous relationship of affiliation with a secret nationwide organization." Indicted were Ruggerio Boiardo, 88, of Livingston; Andrew N. Gerardo, 48, of Newark; Anthony DeVingo, 49, of Roseland; James Vito Montemarano, 37, of Long Branch; Louis Ferrari, 53, of Elberon; Angelo Carme Sica, 49, of West Orange; Thomas DePhillips, 51, of Belleville; and Anthony Lardiere 52, of Nutley. All pleaded innocent in Newark Superior Court and all but DeVingo, Ferrari and Montemarano posted bail and were released.

The indictment also alleged they conspired to murder four people, including Phillip (Brother) Moscato, the owner of a Jersey City dump where the FBI once believed missing former Teamsters union boss Jimmy Hof-fa was buried.
