15. Liquor stores try to halt state hearing Thirteen liquor stores brought suit inv Suffolk Superior Court yesterday to prevent Edward F. Harrington, chairman of the state Alcoholic Beverages Control Commission, from holding a one-man hearing into complaints that the stores reportedly are owned or controlled by the Kappy's package store corporation. As the ABCC hearing opened at 10 a.m. yesterday Harrington was left as the sole member of the three-man commission after Comr.

Ernest Zangrilli disqualified himself from sitting and Comr. Vernon R. Farnsworth withdrew from the case. The hearing was1 scheduled to probe a complaint filed by the Enterprises, and 12 other liquor store license holders that the 13 licensees were operating in violation of a Massachusetts liquor law which prohibits holding of more than three liquor licenses by one individual or company. Judge Samuel Adams declined to act on the request for an injunction against the ABCC and Harrington to halt the hearing pending a court hearing on the suit filed by Kappy's Importing and Distributing Company, of Everett and the 12 other stores.

A brief filed with Judge Adams by counsel for Enterprises and other complainants argued that the ABCC proceedings should not be "hamstrung" by refusal of Zangrilli and Farnsworth to preside at the hearing. Zangrilli last nigut he disqualified himself because his son-in-law, Howard Wayne, is a partner in the law firm of Lawson and Wayne which represents some of the 13 liquor stores being probed. Farnsworth withdrew vfrom the case when the complainants questioned his impartiality.
