In another case, an unmarried, 27-year-old rape victim was asked if she was a virgin. And in a third courtroom, the victim of a brutal gang rape was instructed to describe the assault and tell the jury whether or not she had had an orgasm. "For the rape victim, dealing with the legal system can be almost as traumatic as the attack itself," according to state Rep. Lois Pines (D-Newton). A letter signed by Pines and several other lawmakers says that, "Under the.

present law, it is difficult for a rape victim to take the witness stand knowing that it will be the intent of the defense attorney to destroy her credibility as a witness Often it is the victim who feels on trial." The letter, also signed by psychiatrists, district attorneys and chiefs of police, was sent last week to 240 members of the Massachusetts Legislature, urging their support for a bill prohibiting the admissibility of certain evidence in rape trials. The legislation would prohibit evidence about a victim's prior sexual hisory. Under the provisions of the bill, evidence on the victim's sexual conduct with the'defendant or evidence on the recent conduct of the victim to explain the source of any physical feature-would be allowable, but only after a private hearing before the judge outside the presence of a jury. "We find that many girls who are raped hesitate to make complaints in the first place," said Suffolk County Dist. Atty.

Garrett Byrne. "They don't want to drag their whole life and history into court and frankly, I don't blame them." Another advocate of the rape legislation, Newton Police Chief William Quinn, has said, "Our biggest problem the prosecution of rape cases is the understandable reluctance of the victim to subject herself to a humiliating public examination on her personal life which puts her own character on trial." Last week, an attorney who has successfully defended rapists explained the strategy he uses in the courtroom. "An aggressive defense counsel will paint a mosaic of of promiscuity around the he said. "You do it with a smirk." "In a rape case, the victim's credibility and reputation is pitted against the defendant's credibility and reputation," he added. "Since there are no witnesses, it comes down to credibility.

Early this week, Flaherty will sit down with supporters of the bill to try to work out a compromise. But Flaherty said last week that even if a consensus is not reached, he will not attempt to block passage of the bill this year.
