22, (JP) Thirty three year old Marie Ballentine told a Superior Judge that Film Executive George G. (Buddy) De Sylva once offered to buy the child she bore him for $500,000 if she would give him custody for the rest of his life. Miss Ballentine, De Sylva's for mer secretary, yesterday quoted the 52 year old retired movie pro ducer as telling her in August, 1945: "I'm unhappy over what I have to tell you. I've come prepared to buy your child. I don't think I'll live six months.

I'll give you $500,000. You would have the money, and the child back when I die." She said she refused. Miss Ballentine is asking $1575 a month support for 3 year old Stephen Ballentine. De Sylva seeks to reduce a contract provision for $500 a month to $350. Miss Ballentine described a hasty Mexican marriage late in 1943 to William Moskovita, a San Diego sailor, which she said was arranged at De Sylva's suggestion to give her then unborn child a name.

She testified she was introduced to Moskovita at a bar in Ti Juana by a friend of De Sylva and "half an hour later we were married." The marriage ended in divorce in January, 1944, she added. The child was born in March of that year. Under cross examination, Miss Ballentine acknowledged she had saved nothing from the sale of a $55,000 home De Sylva had given her and admitted spending $500 for liquor in 1946 and a like amount in 1947. De Sylva, who wrote "California, Here I Come" and "Sonny Boy" before he turned movie producer, was not in court. He is suffering from a heart condition.

Clayton Stresses Nped For Marshall Plan Philadelphia, Jan. 22. (Pi Will Clayton, an adviser on economic affairs to the U.S. State Department, says every country on the European continent will collapse into Communism if the Marshall Plan is not adopted. Harrisburg Pa, Cold Wave Hits Midwest Area, Will Head East By the Associated Press Another intense cold wave, di rect from the frigid Hudson Bay region, spread over a wide section of the midwest today. The fresh icy blasts appeared headed for the rest of the eastern half of the country which was chilled by last week severe weather. Temperatures equalling the sub zero lows of last week were indicated and the current cold wave was expected to linger through Saturday. Temperatures tumbled to near 30 degrees below zero in the Da kotas, Minnesota and Wisconsin today.

The biting cold extended as far south as the Lower Missouri and Lower Ohio Valleys and west into Central Nebraska and West ern South Dakota. The line of sub zero readings "'as as far south as Iowa and Northern Illinois. Federal Forecaster H. L. Jacob son in Chicago said the current cold wave promises to cover the same general area struck by last week's intense cold, extending across the eastern half of the country and reaching into the south except Southern Florida.

A moderate nd rapidly moving storm has developed along' the western edge of the cold air and there was a fresh blanket of snow ranging from one to six inches across Western North DaKota, Central South Dakota and Eastern Nebraska. Rain was reported in the warmer air through Central Montana and Western South Da kota. The snow band is expected to spread southeastward today and tonight. Highest temperature in Minnesota today was a predicted zero to 10 below with lows tonight ranginr from 15 to 35 below Nearly similar weather was fore cast for Wisconsin. The mercury dropped to below zero in Chicago today and lows of 5 below tomorrow and 10 on Saturday were predicted.

Generally fair weather and moderate winter temperatures prevail over much of the country outside the cold belt except the northwestern states. Snow fell in Northern New England, measur ing eight niches, but clear and colder weather was predicted. There no sign of rain for dry Northern California while in Southern California citrus belt growers burned smudge pots to protect their crops. San Francisco today entered the third rainless week in a period usually regarded as the rainy sea son, while in Fresno yesterday was the thirty second straight day without measurable rainfall. Con ditions were similar in the agri cultural regions of San Joaquin and Sacramento Valleys and there was concern for the effect on the underground water table, source of irrigation for more than one million acres of land.
