Court held the Sixth Amend If the defendant does not want to supply this list, but still wants to present an alibi defense, he must take the stand. In doing so, he waives his right to silence and may be questioned about any aspect of the case. In 1898 the Supreme Court held the Sixth Amendment guarantee of a jury trial means, among other things a 12-man jury, in Federal cases.

But rights to a jury trial were not made binding upon the states until last year. Therefore, the Williams case tests whether a 12- man jury must be provided in state criminal trials. Williams was given a life sentence for the robbery of Mrs. Marie Salas in Miami in March 1968. The state said he took her wedding ring and another ring from her at gunpoint at her home.

A hearing will be held by the high court next year. 4 plead guilty to June holdup Four men pleaded guilty in Middlesex Superior Court yesterday in the robbery of the County Bank, Broadway, Somerville, last June. Judge Edward J. DeSaulnier Jr. sentenced Peter White, 30, and William J.

Johnston, 33, to seven to 20 years at Walpole State Prison on charges of armed robbery while masked and conspiracy to commit armed robbery. On the same charges, Frederick J. Smith 29, was sentenced to 10 to 20 years. All three are from Montreal, Can. Robert J.

Daddieco, 35, of Revere, had his case continued for disposition. The four men were captured inside the bank with $38,000 in cash by Somerville Ptlmn. Vincent McDonough. Sgt. Raymond Peck was wounded outside the bank by a shotgun blast allegedly fired by a fifth man acting as lookout.

in Moscow on banning force MOSCOW West Germany and the Soviet Union began talks here yesterday on a mutual renunciation of the use of force, the first concrete result of the new West German government's overtures to Eastern Europe. A West German embassy spokesman said Soviet Foreign Minister Andrei Gromyko and West German Ambassador Helmut Allardt met for 90 minutes of "business like and favorable" discussion and agreed that negotiations should continue in the the near future. No date was set for the next meeting. The bilateral agreement being sought by the two countries which could take the form of a treaty or an exchange of declarations already has the blanket endorsement of the North Atlantic Treaty Organization which said in a communique after a summit meeting last week that such agreements could ease tension in Europe. In East Berlin, Communist sources said Moscow's agreement to start bilateral talks with West Germany could pave the way for similar discussions between Bonn and the other- AT THE STATE HOUSE East European countries.

The sources said, however, that bilateral agreements between Bonn and the Communist world ran counter to the thinking of East Germany, which fears that such deals between its allies and the West Germans could damage East German interests. But, the sources said, an agreement between Moscow and Bonn on the renunciation of force could also lead to a similar agreement between Bonn and the East Berlin government, since East German Leader walter U1- bricht has already pledged to follow Moscow's lead on the issue. The two issues were raised in an appeal by Johnny Williams, serving a life sentance in Florida for robbery. He was tried by a six-man jury.

Proof of cancer, virus link seen key to vaccine tests Reuters WASHINGTON- -A leading American scientist said yesterday a vaccine against cancer could be ready for testing in five to 10 years if current research on the link between a virus and certain types of cancer yield further results.

But Dr. Donald Morton, head of the tumor immunology department of the National Cancer Institute, warned in an interview that it could be at least another five to 10 years before it could be known whether such a vaccine was effective. Scientists at the institute say there is increasing evidence of a virus associated closely with human cancers of the bone, cartilage connecting tissues. At a conference in Paris called by the International Union against Cancer last week, reports presented by a member of Dr. Morton's research team and another U.S.

scientist were hailed as the most important in cancer research in 10 years. The question of whether viruses are among the causes of human cancer is one of the key issues still facing scientists. They believe the chances of preventing some forms of cancer may improve if a specific virus could be identified as the cause. Dr. Morton said his team, which has spent three years on the virus project, had discovered antigens--which he described as footprints of the virus in all examined patients suffering from bone cancer.

"What we are trying to do now is to get this virus in large enough amounts to induce malignant tumors in monkeys," he said. "If we can induce the type of tumors we find in humans, then we can develop and test a vaccine against it in monkeys. And if we can prevent the disease in monkeys then it becomes more logical to do the same in he added. Concord to hold 'Conscience Day' CONCORD A "Day of Conscience" to mourn the alleged massacre at My Lai (Song My) in South Vietnam will be held in Concord Saturday.
