J- y- Boston Sunday Glob April 26, 1970 13 Accused Boston detective calls star witness a killer an accessory after the fact of the 1967 murder of William Bennett said yesterday the government's star witness is the slayer By Robert E. Walsh Globe Staff A Boston police detective charged with being ilchrist's 9 people any police information. Defense Clunsel Joseph Balliro rested in th Shields case after puttinf four relatives on the witness stand who said he helping them put up a Christmas tree. Atty. Ronald Chisholm, counsel for Stuart, is expected to call further wit-when the case is resumed tomorrow.

Judge Walter McLaughlin is presiding over the trial which is being heard by a jury of 10 men and six women. shocked when he heard that William Bennett had been shot. He said the Bennetts were his informers. Under cross examination he said he would not reveal the names of his informers ev even to high police officials and this was a common police practice. He said, "Even the FBI does not reveal the names of informers." Stuart explained that it takes a long time to develop contacts.

Under cross examination he said he did not give the racket earn about crime and the undervrorld. Stuart denied ever taking a payoff but said he did meet John Viglas at 414 Tremont st Viglas was the assistant racket bookkeeper who testified that each week from the middle of 1967 to the middle of 1968 that he put $50 in an envelope marked with the initials B.S. Viglas said Stuart had been pointed out to him as B.S. Stuart in his testimony said that he was nevr in-troudced to Viglas by Salemme but once was introduced to him by Peter Poulos. Stuart said Poulos was in the rackets but he did not consider Poulos to be really bad person.

The police officer also said he had never seen Shields until he had come into the courtroom for the opening of the trial but ha knew Daddieco because he arrested Daddieco in 1962 for parole violation and later refused to help in geting him a license. Stuart said the testimony given by Det John Doyle was untrue. He said Doyle approahed him once with the story that Stuart was to be called as a defense witness in the Shields murder case and Stuart insisted that it was not true. Under cross examination by prosecutor Lawrence Cameron, Stuart admitted that in the early sixties he had been cosigner of a loan put through the Lord eaconsfield Co. with the names of Walter Bennett and another man appearing on it.

Stuart testified that he was friendly with Edward "Wimpy" Bennett and his brother, Walter, both of whom disappared in 1967, and also knew William Bennett He said he was gilchrist's HA assist. 1 1 Hlilchrist's lleged to have driven, Flernmi back to the scene to have driven him back of the murder to see if the botched job, had left the victim was dead and later driveway. Salemme and Flernmi, death car with the motor acording to Dadddieco's testimony, were supposed to have decided that both pue spiarqg 'ajauAV Xbab Shields and Grasso were to be killed because of the messed up murder. On the witness stand yesterday, Stuart testified that the prosecutor, in urging him to admit he was at the murder sscene with the plotters, was supposed to have said about Daddieco, "This guy tells a good story. He told me he killed Grasso.

If you come along with us you'll come out smelling like a rose." Stuart testified the prosecutor bit his Tongue after he said it Stuart said that he couldn't go along with it because he was sure Daddieco was lying. Stuart also testified that he wzs not at the scene of the shooting on Dec. 23, 1967, and that he was at home on that night. He said he learned of the Bennett killing on the same night through a call from his superior Sgt. Lynch of the intelligence unit.

Stuart also testified that he never dated Patricia Clary of Green, R.I., who earlier on the witness stand claimed to be his girl friend. He said the conversation he is supposed to have had with her about the Bennett murder was only partly true but it was a conversation which she overheard ina Hyd Park club. Stuart admitted he has seen and talked with the girl in severa different night clubs in the area ut it was all part of his job as an intelligence officer whose asignment was te of the man who set up the Bennett murder. Det. William Stuart testified in Suffolk Superior Court that Robert Daddi-eco, the key government witness, killed Richard Grasso who was the driver of the car in which Bennett was killed.

According to earlier testimony Grasso's body was found stuffed in the trunk of the Bennett death car in Brookline six days after Bennett was killed. Stuart was testifying in his own defense in the trial of Hugh J. Shields 3, of street, South Boston, who is charged with being the triggerman ih the Bennett murder. Stuart Is charged with being an accessory in the murder in that it Is alleged that he helped the plotters of the slaying remove the death car from the scene. Daddieco, convict turned informer, testified that six men planned the murder of Bennett.

Planners of the crime, according to Daddieco, were Francis Salemme and Stephen Flernmi, now fugitives, Richard Grasso and Peter Poulos, both now dead, and Shields, the defendant, and Daddieco himself. Daddieco said that Grasso was the bodyguard of Bennett and the only man who could get close to him. The plan called for Bennett to be shot to death in the caron Harvard street and driven to a spot later for burial The plan misfired when Bennett, seeing the gun in the hand of Shields, hit the door handle and fell out onto the street. A cabbie coming along saw the body fall out and prevented Salemme Flernmi and Daddieco in a car following the death car from picking up the body. According to Daddieco's testimony Flernmi called the Boston detective to a Dorchester av.
