Boston Evening Globe Thursday, February il, irTi 'ink's star witness' wife collapses on stand J-ML 14 Mrs. Kelley from further testimony. Arthur Snodgrass, a room clerk at the Golden Strand Hotel in Hollywood, Fla. next took the witness stand and he testified that defendant Charles Domenico ran up a motel bill of $2500 during his stay in early 1969. She has suffered at least one full epilepic seiszure.

He described it as a "deep brain stem" type. He said her eyes were rolling in her head and the tip-off to the attack came when she failed to respond to the question. Judge Roy then excused Snodgrass said Domenico had an $85-a-day room and later switched to a $60 room. His fees included charges for flowers, swimming and diving courses, and valet services, he said. The defense then rested and Judge Roy ordered the final arguments.

Cabby 'arrogance' called part of job the judge that taxi drivers "can be rather arrogant." The judge ordered the case be made ready for a trial on slotnick's appeal by Feb. 16. The doctor testified in the abdence of the jury and Judge Roy then gave the order "bring the jury down." The jury of 11 men and four women then took their seats in the spectator-filled courtroom and Atty. Usher Moren was on his fifth question when Mrs. Kelley slumped over.

A red-heaed US marshal dashed toward the witness stand but was stopped halfway across the room by court officer James D. Collins. Dr. Weintrub was at Mrs. Kelley's side by the time many of the spectators realized what had happened.

Many spectators started jumping to their feet and the judge immediately cleared the courtroom. Mrs. Kelley was revived after the doctor worked over her for a few minutes. She was then led from the courtroom by court officers and marshals. Testimony by the doctor indicated that Kelley and his wife had been staying at the US Naval Hospital at Portsmouth and also in the Boston Naval Hospital in Chelsea.

After court resumed Judge Roy called Dr. Weintrub back and asked if it would be advisable for Mrs. Kelley to continue. Dr. Weintrub said, "No.

By Robert E. Walsh Globe Staff Mrs. John J. Kelley of Watertown, wife of the government's key witness in the BBrink's armed robbery trial, collapsed today on the witness stand in Suffolk Superior Court Mrs. Kelley was called to the stand by defense counsel Usher Moren after Superior Court Judge James C.

Roy warned there was "a risk involved in calling this witness." A Navy doctor who had testified previously on her condition rushed to Mrs. Kelly's aid as she slumped in the witness chair. At the time Mrs. Kelley, 60, was being questioned about the whereabouts of her husband the night of Dec 28, 1971. That was the night a Brink's truck was robbed of a half million dollars in the North Eni of Boston.

Previously, Mrs. Kelley's husband pleaded guilty to armed robbery. He testified to his participation in the robbery and identified three of the four defendants on trial as involved in the robbery. Charged with armed robbery are: Charles A. Domenico, 38, of Putnam Braintree, Rocco No-vello, 33, of Moss Hill Jamaica Plain, and Carme- lo Merlino, 36, of Tilden Canton.

A fourth defendant, William J. Cresta, 33, of Headland way, Medford is charged with being an accessory before the fact Mrs. Kelley was to be the last witness called before the defense rested. This morning after the court opened Dr. Michael Weintrub of the Boston Naval Hospital was called to the stand at the request of the Commonwealth.

Dr. Weintrub testified that Mrs. kelley had been treated for epilepsy and while under treatment sustained several seizures. The doctor said the patient should not be subjected to stress or strain. However, under cross-examination, he insisted he could not say whether or not the patient would suffer an attack.

He explained she might be under stress, but still might not suffer a seizure and that this would probably depend upon her emotional involvement in the case. Judge Roy said, "It must be obvious to the defense that there is a risk involved if this lady goes on the witness stand. I also wish to remind counsel of the privilege that exists between husband and wife before I order her to appear." AMERICA'S LARGEST FAMH.Y CLOTHING CHAIN It seems to be an occupational hazard that taxi drivers be "fresh and arrogant," according to arguments today in Suffolk Superior Court. The arguments were made in the case of a Chelsea taxi driver whose license was revoked by the Boston Police Dept. for alleged violations at Logan Airport.

A report filed with Judge Eugene A. Hudson by Boston Police Commr. Edmund L. McNamara charged that the driver, Lester Sotnick of Shurtleff Chelsea, had his license revoked after several alleged violations of rules requiring taxi drivers to refrain from soliciting extra passengers and rquiring taxis to stay in the waiting line at the airport. Slotnick charged he was not given a proper notice of the hearing at which his li cense was revoked.

The report filed by Commr. McNamara stated that since January, 1969, Slotnick had been cited three times for failure to remain on the taxi line and was twice convicted East Boston District Court. The report also said Slotnick had been reprimanded on citizen complaints of Slotnick soliciting additional passengers for his cab. The Boston police following a hearing before a board of three captains, ordered Slotnick's license revoked last Dec. 16.

Judge udson noted that he has been atthe airport a number of times waiting for a taxi and had drivers refuse to take him into can't blame citizens who get mad about that," the judge commented.
