Kelley, 56, made the admission under cross examination as a government On trial besides Patriarca in connection with the two Providence murders are Rudolph Sciarra, 45, of Johnston, R.I.; Maurice Lerner, 33, of Brookline, and Robert Fair-brothers, 32, and John Rossi, 29, both of Providence. Patriarca and Sciarra are charged with conspiracy and with being accessaries before the fact of the killings while the other three are charged with the actual murders. The grey-haired Kelley, who is himself under indictment for the $582,000 Brink's armored truck robbery in Boston in December, 1968, has been the key Rhode Island state witness in the murder trial. He testified earlier today that on Apr.

20, 1968, the day of the double murder, he waited in a golf course parking lot bouncing golf He said it was in connection with a jewel robbery that Kelley himself had planned at the Bigelow Ken-nard Co. in Boston. Kelley said that the robbery never came off but that Bennett brought him to see Patriarca in Providence "pertaining to the disposition of the loot from the jewel robbery because Patriarca would pay the best price." When asked, Kelley said witness in the trial of Patriarca and four others for the gangland murders of Rudolph Marfeo and Anthony Melei in Providence in April, 1968. Kelley has previously testified that he helped the defendants plan the murders. Today, under questioning by Carmine Rao, counsel for Patriarca, Kel-lev said his first meeting with Patriarca was brought about by Bennett.

"Where is he now?" Rao asked. Kelley said, "I have no idea," and then Kelley's added response drew laughter in the courtroom when he said, "I understand Mr. Bennett is not available." Bennett, who came from Roxbury, has been missing for a number of years and is presumed to be a gangland murder victim. Francis X. Bellotti has withdrawn as counsel for Boston Police Det. William W. Stuart, 41, of Blake Mattapan, accused of complicity in a 1967 gang murder. Notification of the withdrawal was given to Suffolk Superior Court Judge Wilfred Paquet today by Atty.

James J. Sullivan Jr. of 100 State who filed an appearance as trail counsel to replace Bellotti. Stuart has pleaded innocent to four indictments charging him with being an accessory after the fact of the murder of William Bennett in Dorchester. One is dead and two others are still at large. Only Hugh Shields, 32, of Roxbury, is in custody. Sullivan told Judge Paquet he plans to file a motion to separate Stuart's trial from that of Shields, which is set for Apr. 7. Judge Paquet said he would give Sullivan until Mar.

Joseph Maloney, counsel for the F. B. Mutrie Motor Transportation of Waltham, told the court that he had not received copies of the indictments and therefore had no knowledge of them. Judge Moynihan granted the continuance and ordered Asst. Atty.
