Coddaire that there was no illegal search and seizure in connection with finding of the weapons.

The Court said that after police arrested the suspects on the Lynnway, the car and its contents with the guns were properly seized in connection with the arrest. There was probable cause based on the police radio broadcast for the officers to stop the robbers car and arrest the occupants, the high court said. The Court rejected Blackburn's claim that he should have been given a change of venue for his trial because headline publicity that accompanied the robbery, and arrest. The Court said the right to fair trial does not mean the trial must be in a place where few citizens have heard of the case. "Intelligent persons read and take an interest in events," the Court said.

"Because of the same endowments, they are likely to give-due regard to the evidence and to disregard rumor, report, and suspicion in the solemnity of a courtroom, defendant is tried and his reputation and his liberty or his life are at stake," the Court said. All citizens who have read about or been interested in a crime need not be excluded from a jury in order to insure a fair trial, the Mass. Supreme Judicial Court ruled today. The court made the ruling in upholding the conviction and State Prison sentence given Robert J. Blackburn, 41, of Detroit, for his part in the $75,000 jewel robbery July 10, 1966 at the home of John Riber, a Mar-blehead millionaire.

Blackburn and two other men. Ronald C. Chandler, 29, of Miami, and Omar Taylor, 30, of Louisville, were found guilty of armed robbery and assault on Rimer and seven other men and women in Rimer's home. All were given prison terms. Rimer was struck by the robbers and tied up but managed to get free and called police.

Blackburn and the other two men were captured on the Lynnway, Lynn, by Lynn police officer Robert J. Queena and State Police Cpl Daniel L. Delaney. The officers received a police radio description of the robbers car and found two guns in the car. The Court decision was written by Justice Arthur E.

Whittemore. Humphrey, wife of the Vice President, underwent today what was described as routine surgery to correct a non-malignant pelvic disorder. At Bethesda Naval Medical Center she was reported "in satisfactory post-operative condition." Capt Walter M. Lonergan, the center's chief of obstetrics and gynecology, performed the two and three-quarter hour operation. Vice President Humphrey and their daughter, Mrs. Bruce Solomonson of Minneapolis, were at the hospital during the surgery.
