Charged with first degree murder are Wilfred Roy French, 38, of Everett and Louis Grieco, 51, of Peabody. The accessory charge carries a death sentence with conviction. Civetti testified that he made three payments on time then fell behind. 12, 1965. Testifying in his own defense against a charge of first degree murder in Suffolk Superior Court, French declared he never owned, carried or fired a gun in his life. Stepping from the stand French acted out on the courtroom floor what he claimed happened that fateful night in the alley which he and Deegan entered to make "a soft score' (an easy burglary of a Chelsea loan company). In essence, French corroborated testimony given by state's witness Anthony Stathopoulos, the third member of the burglary team that night who was positioned outside the alley as the driver of the getaway car. DEEGAN IN LEAD French said he entered the alley with Deegan in the lead.

"I heard a loud noise, the way Tony described it, said French. "I spun around to make a retreat." French's lawyer, Anthony McLaughlin, asked French to act out just what he did. The lawyer played the part of Deegan. French said, "Teddy said, Follow They were about 15 feet into the alley when something happened, French testified. The witness said, "There was the loud noise and I don't know whether I bumped into Teddy or we tangled feet, but I fell." French then dropped to the floor in front of the jury.

Then employing a crab-walk with his weight on his fingertips and toes, French scurried across the courtroom floor to illustrate how he moved out of the alleyway. "I waited till the shots stopped and then I got up -like this," French said, moving into a crouch. McLaughlin asked' how many shots there were.
