The Boston Globe Asserting Senate's Constitutional Prerogatives Frldar, November 17. 1967 23 Says Fulbright the United States is not al THANKSgTVINQ Thursday after nearly four months of on-and-off discussion represented both a linguistic and political patchwork. It was sufficient to win the affirmative votes of 14 members present, approval of two others by proxy and the expected approval of the three absentees. The central phrase declares that commitment of armed forces "to hostilities on foreign territory" other than to repel an attack on the United States or to protect American citizens and property should "reqviire the United States; and "Whereas the authority to initiate war is vested in Congress by the Constitution: now. therefore, be it "Resolved, that a commitment for purposes of this resolution means the use of, or promise to a foreign state or people to use, the armed forces of the United States either immediately or upon the happening of certain events, and "That it is the sense of the Senate that, under arty circumstances which may arise in the future pertaining to situations in which involvement, the SEATO Treaty and the Tonkin Gulf Resolution.

Nonetheless, Fulbright said he felt the resolution would have "a healthy effect on Congress and even on the executive" branch and should lead to "more prudent and restrained action" by the President. Here is the text of the resolution: "Whereas the executive and legislative branches of the United States government have joint responsibility and authority to formulate the foreign policy of affirmative action by Congress specifically." To win unanimous approval, Fulbright agreed that the committee report will make clear that the resoultion applies only to future cases, meaning it does not affect Vietnam, and that it does not "alter existing treaties, acts of Congress including joint resolutions, or other past actions or commitments of the government of the United States."
