The beach property in Mash-pee has been a subject of controversy for several years since the Legislature approved the acquisition of the beach although there was testimony that the land was subject to flooding at high tides and not feasible for development.

The Department of Public Works arranged to pay $361,000 for three of the parcels involved. Later, the Legislature retracted and voted against the project. Only a few months ago, the attorney general ruled that because one of the three property owners, Dr. Shields Warren of Brookline, wanted to hold the state to its agreement to buy his land that the Commonwealth had no choice but to pay. Since, the attorney general's office has negotiated with Dr.

(38 sq. yds.) Schools Chief Resigns Over Amesbury Site AMESBURY School Supt. Judson R. Merrill resigned last right in protest over the selection of a site for the town's new high school. Making the latest move in a 15-month controversy, Merrill told the School Board he "could not, in conscience, remain on the job and have a part in building a new high school on the site of the building burned last year." A special town meeting on June 1 reversed the recommendation of school officials to seek a new site for the high school, and went ahead with plans to combine a new senior high with the junior high school remaining on the fire site.

Merrill, 36-year-old Korean veteran and Bowdoin graduate came to Amesbury from a post in Scituate in 1962. His resignation is effective July 31.
