Carew Who is Hearing Custody Fight NEW YORK, Oct. tittle Gloria Vanderbilt prefers her aunt Mrs. Harry Payne Whitney, to her mother.

She made this emphatically clear in a three-hour visit with supreme court justice John F. Carew, is presiding over trial of Mrs. Gloria Morgan Vanderbilt's suit to regain custody of the 10-year-old child rrorn Mrs. Whitney, fier sister- in-law. Justice Carew previously had said the child's preference would have considerable weight in his decision.

Gloria's visit was unheralded and attended by much secrecy. Everything had been prepared to provide a natural a setting as possibls. The entire sixth floor corridor of the supfeme court building, where the- judge's cBambers are located, isolated. Only counsel for the opposing and an unobetruBive were present during the interview. Gloria sat on a leather-backed swivel chair next to Justice Carew talked to her in a kindly, informal way.

MODERNIZATION PROGRAM PROVIDES RICH REWARD CAPITAL REPORTS FOUR VIOLENT DEATHS INDIANAPOLIS, Oct. 25 violent death toll of -four ivea in'Marion county within 24 hours was recorded. The victims were Elzea Collier; John W. Gralam, 83; Paul Preston, 17: and William Marshall, 51, negro, all of Indianapolis.

Collier was killed when he was juried nearly 100 feet by an automobile, the driver of which fled. Graham was killed on State road northeast of here when he was struck by an automobile driven by A. D. Whipple, Alexandria. Preston died of injuries suffered when he fell from a truck and the negro succumbed to injuries suffered in an automobile accident Oct.

Digan, chairman of the Cass County Modernization Campaign Committee, laid stress on the rich returns that await those who invest even modestly in reconditioning of homes and other buildings that have suffered during the era of economic stress. Digan said, "is that every repair project undertaken now results in a saving to the property owner in two ways: irst, reconditioning that seems of minor importance at the present time will prevent costlier repair jobs later on; a.nd second, the cost of building materials and lahor are likely to rise as businesss conditions improve. GRAND JURY PROBES DICE GAME MURDER FRANKLIN, Oct. special meeting of the Johnson county grand jury to investigate the fatal stabbing of Charles Whitlock, 17. in a dice game at Edin- Tjurg, Sunday, wag called here today. Chanley Hedger. alleged slayer, is being held in the: Karion county jail here where he was taken as a precaution against possible mob violence by friends of Whitlock.

Police said they were told the stabbing occurred when Whitlock threw the dice away after losing all of his money in the game. RETIREMENT ACT UNCONSTITUTIONAL WASHINGTON, Oct. (UP) railroad retirement act, affecting about 1,000,000 railroad em- ployes, was held unconstitutiona' by Chief Justice Alfred A. Wheat of District Supreme court. Justice Wheat granted peti tion of 134 major railroads asking for an injunction to restrain en forcement of the' a.ct by the rail road retirement board.

The act sets ivp a retirement and pension system for all employes railroads subject to ttie Interstate Commerce Act.
