Governor Hobby announced tonight that he had declined to grant the request of the state council of defense, for a special session of the legislature for the purpose of making an appropriation for the relief of the drouth sufferers. The announcement wan made by the governor, after he had received official notification from J. F. Carl, of San Antonio, secretary of the state council, of the passage of a resolution by that body at Its Pullas meeting, asking for the convening of the legislature in special session.

Governor Hobby believes that the regular session next January can accomplish all with respect to drouth relief that a special session can accomplish. He says It la clear to him that an appropriation for relief in the form of a contribution can only be made upon the adoption of a constitutional amendment permitting It, and such an amendment can only be submitted at a regular session of the legislature. Death from tyflnenz. The first death in Texas from Spanish influenza was reported to the slate health department today by the county health officer of Jones county. The health officers wired as follows: "Suspect epidemic of Spanish influenza in this county from a person sent home III from Norfolk, Va.

Stowe. who made the second arrest of the man, Terrili answers the description of a negro with a police record in San Antonio for the last 14 years, who has spent at least one two-year term in the penitentiary and a previous period in the reform school. When Stowe was on the police force of San Antonio his testimony got the man a two-year penitentiary sentence In 1909.

He made a scene in the court room and swore that he would kill Stowe when ho got out of prison later Stowe saw the negro hero In El Paso, and recognized the former convict, although unrecognized by the man. He notified headquarters of the man's record and Inter ho was arrested by Captain Urcet. The records show that he broke Jail after ho was apprehended and escaped to Iteming, N. where ho was arrested, but again broke jail and proceeded to Douglas, Ariz, There he broke jieil and whs rearrested and sent In custody "to San Antonio.
