One week before inaugura of presi- indlcated L. Lion, the cabinet slate dent-elect Hoover was to be as follows: Secretary of Stimson, of New York. Secretary of the W. Mellon, of. Pensylvania Secretary of J.

Donovan, of New York. Secretary of the Francis Adams, of Massachusetts. Attorney D- Mitchell, of Minnessota Postmaster F. Brown, of Ohio. Secretary of (probably former Gov Samuel R.

Secretary of STATE RESTS IN J0HHST0N CASE pended Oklahoma Governor Dropped 0' situation last night I as president-elect Hoover concluded another busy day of conferences at his street home, including an extended talk with Col. Donovan.

The New Yorker, now assistant at- tornev general, arrived here unex- 1 pec ted ly from Santa Fe, where he has been acting as the special representative of the federal government in the negotiations over the waters of the Colorado river. Donovan talked for 50 minutes i with the president-elect, and later had lunch with president Cool id go i at the white house, He managed to elude all news correspondents, arid, for the remainder of the day, was in seclusion. The information forthcoming from his home and office was that he intended to return immediately to Santa Fe, and, in turn, ight re- I trace his steps to Washington in tbe immediate future. There was little doubt that ht came here at the request of the Qne Charge Against SllS- president-elect. It was equally cer- tain that Mr.

Hoover would not summon him at this time unless he desired to offer him a place in his official family. From the day of his election, the public appears to have taken it for granted that Mr. Mellon would continue as secretary of the treasury and that Col. William J. Donovan would have whatever place in the cabinet Mr.

Hoover believed he could be most useful. Whether this would be the attorney generalship or the secretaryship of war, has long been a subject of general speculation. One of the most dififcult posts to fill in any cabinet is that of attorney Apparently Mr. Hoover's experience has been no exception to the general rule. William D.

Mitchell, of Minnesota, solicitor general of the United States, will be Mr. attorney general, unless there is a change between now and next Monday. Among the labor leaders who have been coming to Washington for consultation with the next president, there appears to be an unanimity of belief that William N. Doak, of West Virginia, who has long been on the tentative cabinet list, will succeed James J. Davis as secretary of labor.

Hoover talked farm and tariff legislation for the extra session of congress with speaker Nicholas Longworth of the house. He and Mrs. Longworth, the former Alice Roosevelt, were luncheon guests. Longworth urged confining tariff revision to those industries affected by changes in world conditions, and told next president that April 10 will be the earliest possible date for convening the new congress. Mr.

Hoover also talked tariff with F. II. Hagenbarth, president of the Wool association. He discussed the national origins plan of determining immigration with senator Reed, Republican, of Pennsylvania. Johnston late Monday with the testimony of a woman regarding the alleged domination of Mrs. O. Hammonds, Johnston's secretary and political advisor, over the administration. Counsel for Johnston immediately asked the senate court of impeach- i ment for two days to prepare its case.

The development came suddenly as the first day of the third week in the trial against the sus- 1pened governor on charges purporting incompetency and eorrup- tion during his two-year term in i office. Mrs, George D. Wray, chief clerk in office, and last witness for the prosecution, said it was her duty to admit guests to the gov- office. When Mrs. Hammond? insisted on taking this responsibility, Mrs.

Wray testified she went to the governor about it. She said the governor insisted on having the office door open when he and Mrs Hammonds were conversing. Mrs. Hammonds should come in, she would be under suspicion If the doors were Mrs. Wray quoted Johnston as saying.

The witness said she and the governor devised a code whereby he might know who was in the outer office without Mrs. Hammonds having to I intervene. One Charge Dismissed Tbe prosecution, in closing, dismissed one of tbe 11 charges against the governor, that of alleged illega1 use of the national guard in resist- ing an attempted self-convened ses- sion of the state legislature in December, 1917, Scores of witnesses were called on i the stand by the house board of managers in an effort to prove their contention that Johnston was incompetent. Several testified regard ing alleged deals in awarding contracts in the highway department and cattle transactions. Acts of clemency, alleged suspicious cattle deals, alleged unlawful deficiency certificate issuance, and asserted domination by the resigned secretary were stressed in the prosecution case.
