the appellant. Mr. Pope had. bought from the appellant a half-interest In the Eldorado. In tbe Trail Creek mlnlnjr district tor 35.230, paid the money and got' the deeds.

It turned out afterwards that the Maacott claim, previously located. Included within Its limits the discovery post and tho (rreater part of tbe Eldorado, so Mr. Pope got practically nothing. The question then was whether or not. un der the mining; laws of British Columbia, the money could be recovered In the absence of fraud.

The trial Judge decided In favor of the defendant Cole, and held that the sale was of a chattel real and that no warranty could be implied, and there was no covenant for warranty in the deeds. The children were there In full force, and with unabated Interest, at 4.15, and the church was crowded in the evening at 8 o'clock. Many ad-, ditlonal requests for prayer were received, and at the conclusion of the mission sermon and instruction fully two-thirds of the congregation remain-, ed for the Father Huntington's great power as a mission preacher was more evident than ever last night, and there waa a marked response on the part of those present to his earnest pleading with them. The services In Grace church' yesterday commenced with the celebration of the holy communion at 7-30 a.m., at which seventeen attended. Tbe service at 10.30 was attended by thirty and the afternoon service at 4 o'clock was attended by fifty. In the evening about 180 turned ont to hear Rev.

C. H. Brent of Boston. The subject of the sermon was the death and the Judgment. The exposition of the subject was one -of the most instructive heard in Ottawa for acme time.

The services at Christ Church Cathedral yesterday continued to grow In interest, and many more people are In attendance at each service. In addition to celebrations of the holy com munion at 7 and 8, another has Seen added at if. so that every one. may have an opportunity of attending. At I p.

m. the Cathedral was filled. Father Osborne in most vivid and striking language portrayed a soul "half. dead" in sin. To-morrow evening the 8 p.

m. service will be for men only, with addresses by Rev. Fathers Conranand Osborne. The congregation last night at St John's church showed that the Interest in the mission Is Increasing, If numbers are- any criterion. Rev.

Macrae, the police magistrate of the city of Victoria. The magistrate tried a sailor, Jos. -T. Leddy, en a charge made by the master ot his ship of refusing duty and sentenced him to 28 days imprisonment. On being told that the full penalty was not pressed for he reduced the sentence to 14 dsi at hard labor.

The sailor claimed that he was dismissed by the master of the ship, who afterwards changed his mind. The magistrate, however, would not permit him. so the sailor says, to make a defence, but proceeded to brow beat As soon as Leddys time- waa up he went. to Attorney-General Martin. and told him what- happened: Both- proceeded to the magistrate.
