Santa Fe Goldand Copper Mining Co. JERSEY CITY, Jan 26 J. G. Metz of the Leonard Lewisohn estate, was elected a director of the Santa Fe Gold Copper Mining Co at the annual meeting, succeeding J. P.

Sussmann, who has resigned from both the presidency and directorate. The other directors were reelected. In his annual report to the stockholders, Mr Sussmann says: "There has been a gratifying increase in tonnage of developed ore. The greater part has been found In hitheto unexplored ground, and as the limit of this ore body has not been reached, we feel justified in recommending continuation of developing the mine without attempt-ins; to treat the ore until the quality of ore in sight is sufficiently large to warrant enlarging and improving the reduction plant. The average grade of the ore is fully equal to if not better than thafc in the past, and there is also quite an amount of high-grade smelting ore." New York Consolidated Gas Company Makes Petition to the Supreme Court. WASHINGTON, Jan 26 A petition for a rehearing In the New Tork consolidated gas case was filed In the supreme court of the United States this afternoon. The company represents that the decree of the court Is inconsistent with its conclusions, especially as regards the unconstitutionality of the requirement of the New York law relative to pressure. It also is contended that controlling facts In the case have been overlooked or misapprehended, one of which is the fact that profits from an abnormal increase in sales had already been assumed and included by the circuit court. The petition also takes issue with the conclusions of the court that only a slight reduction in the valuation of the tangible property would be necessary to produce a 6 percent return.

The petition for rehearing Is signed by Atty John A. Garver, James M. Beck and Charles F. Mathewson, and they represent that the supreme court departed from all precedent in falling to grant relief snd In placing the entire cost of the litigation upon a complainant who has sustained a substantial portion of his bill. The portion to which they refer is that relating to the pressure requirements of the 80-cent gas law.

the unconstitutionality of which was by the court, and it is pointed out that while this was done the court inadvertently failed to grant relief from this requirement. It is contended in the petition that in naming 5 percent as the present return upon the court's valuation of the gas property which was $05,612,435. the court has -in effect declared the whole law to be invalid because at the same time thj court said that 6 percent would be a reasonable return. A It Is intimated that in the brief time given by the supreme court to the sub-Icct it could not be expected that It would question the soundness of the findings of the master who had the case under consideration for a year and of tho circuit court, which gave more than a week to the argument of the case. The petition represents that unless eiven an opportunity to contest Lie rate before it is applied inevitable confiscation must be the result.
