Stearns Kendall Abbott Asserts His Innocence In an Interesting Letter to Wendell Phillips. He Says He was Convicted on Circumstantial Evidence. CSpeclal Despatch to The Boston Globe. 1 Ateb, March 19 Tbe Public Spirit, published today, contains tbe following letter from Stearns Kendall Abbott to Wendell i'bilhps: Dkab Sir As you bave become identified with tbe cause of religion and humanity to tbe extent of heme recoirnlxed as tbe willing friend of all men, especially tne unfortunate, and as a word spoken by yourself in behalf of any cause Is al-wjys sure to excite tbe most benevolent impulses of tbe public mind, I feel Irresistibly impelled in my present dire extremity, to address you in this form, by way of most respecttully soliciting your kindest consiBeratioa in regard to my greatest of individual misfortunes. I am at this time under sentence of death, for tbe alleged crime of murder, tbe particulars of wbicb you are doubtlessly familiar witb to some extent.

In fortunate circumstances yet none but what micht at any time involve the most respectable and honest man in tbe same difficulty and not guilt, in this in stance, have placed me in tbe perilous position I now occupy; for, although I am convicted and inrhi an ignominious ueatn, am reflection that in truth I can raise both my heart and bands to Almighty God, wim a cieaa conscience, Knowing vnas lie Shall Acquit Me af Rearing tbe Stain af Murder either upon heart or band. I know that all protestations of innocence from condemned criminals are of little avail; yet it might be allowed when a man is standing, as it were, on tbe very brink of bis own grave, with reason enough left to realize keenly bis accountability to One whom be cannot deceive tbat there may be a possibility, at least, even if tbe probability cannot be conceded, that he may speak the truth. I have been convicted entirely upon circumstantial evidence, of murdering a woman, whom, to the best of my knowledge, I never saw in my life; a woman toward whom I could have no enmity, and.no motive under heaven for wishing or doing ber any injury. Tbe chain of evidence against me-may appear to be a strong chain in its entirety, but there is hardly a link in tbe chain, wbicb, viewed as pointing to myself as tne source of tbe death of Mrs. Maria L.

Crue, presents anything more tangible than a mere inference. Circumstantial evidence has oft-times been proven to be at fault when too late to repair tbe wrong tbat has been the result of trusting to it; so otten in tact tuat it would seem as though the very strongest evidence of that kind should always be subject to a doubt, especially when a man's life binges upon it. It was shown that I was in the neighborhood ot wbere the crime was committed on tbe day it occurred. It was also just as clearly shown that there were other suspicious, unknown, unaccounted for meu in tbat same locality on the same day. I was arrested, they were not.

One of those men, according to description, strongly resembled myself, yet it was shown I could not bave been the man. If tbat man nad been arested before myself, perhaps be would lo today in my place and witb fairer justice. To that man may be attributable tbe mistaken identification tbat has fixed tbe crime upon myself. But if be were to be arrested now, although there might be as strong or stronger circumstances azainst blm as acrainst myself, yet they miebt not be brought home to bim witb the same force that was allowed to weigh against me. It was shown that I Have Beea a Bad Man all My X.ife.

I plead guilty to that. But I tbink that if the truth could be known it would be conceded that my badness bas been tbe result of my being more tbe victim of circumstances than from any inherent propensity to a wrongdoing. Tbe list of ofleuces recorded against me are all small. I do not attempt to excuse tbetn; but tbev were of little Injury to any one, and of no 'benefit to myself, certainly, as I paid their full penalty. 1 have never been guilty of an offence against the person, and never had tbe reputation of being a quarrelsome man.

It a man possesses such a disposition as will enable him to commit a coldblooded murder, with no other object than the gratification of a tienuisb propensity, he will manliest it in some form before he has become upwards of forty years of age: and if be meditates sucb a crime for the purpose of robbery he will not choose for his victim one of tbe poorest persons in tbis world's goods that can be found, and that person a woman whom he never knew. 1 am a poor man, almost friendless aud helpless; consequently I have not been able to bring those influences to bear, which, with other men in similar cases aid so much in tbeir favor; and my bad record subjected me to a weight of prejudice beyond what would bave been developed by the facts and evidence in the case itself. I feel that I could enter upon a life sentence of imprisonment with fair hope that sooner or later new lint may dawn upon the terrjlJe crime I am now suffering lor, and that at least I may have the natural course of time in which to repent properly of the misdeeds I am reallv guilty of. To that end I most respectfully "request that you and all good Christian men will lend your voice and name, as opportunity may render convenient, to the furtherance of a petition to tbe Governor and Council for the commutation of tbe sentence I am now under. If I must die, it will be for another's crime; and I can only trust in God, that He will in His own good time, cause my death to be used as one more strong argument against condemning men to death ou circumstantial evidence.

Yours sincerely, Stkarns K. ABBOTT. East Cambridge Jail, March 6, 1881. Telerraphlc Tidbits. The Wisconsin Senate yesterday passed the woman stiff rage resolution to a third reading.
