Asarco smelter's $81 million modernization project, huddled with compa-: ny officials Tuesday night to negotiate a possible settlement that could prevent a two-week hearing before the Texas Air Control Board.

Asarco wants to increase copper production from about 100,000 tons to 168,000 tons per year with new pollution-control equipment, which the company says will cut pollutants by about 45,000 tons. But said he is fighting the plan because the 104-year-old copper smelter 1S not doing enough to clean up El Paso's dirty air. filed an objection to Asarco's permit request with the Texas Air Control Board. Air Control Board hearing examiner Bill Ehret, recessed a hearing. on Asarco's permit application to give and smelter officals a chance to pursue a.

settlement. "I don't have any feel for it. We would love to have a settlement if we can get something concrete," Asarco Plant Manager John Shaw said during a break in the -door negotiations. "I'm sure that if it's reasonable and we can agree to it then we could settle it." would not say what concessions he wants. "It's an international matter; it's not just El Paso because there are people across the river from Asarco less than 300 yards with heavy concentrations (of lead)," said.

Asarco says the new technology will reduce lead emissions by 32 percent from 20 tons to 14 tons per year. "They aren't reducing enough. Our position is they should be reducing it more," said, citing stricter stan- to move bins and the demonstration garden of desert plants there. And moving the fence would create more problems, she said. "If we remove the fence, we're opening both the building and the mural to vandals," Mahlow said.

"We did locate there for recycling efforts. There's no way we could function if we didn't have the fence." But Gandara said the mosaic shouldn't have to compete for attention at the city-owned center. Sierra Club Chairman Ted Mertig said the original goal of leasing the building from the city was to establish a recycling center. "If we have to go out of the recycling business, then we would have to withdraw from our lease. We would have to find another location," he said.

dards by the Centers for Disease Control. Safe thresholds for lead are unknown, said. His opposition has caused a contested case and cost Asarco millions of dollars. Interest on the company's $81 million purchase of the equipment from Germany and Finland runs nearly $1 million a month, Shaw said. The company could have had the equipment installed and running at least three months ago.

The delay could set the company's plans back by at least 15 months and cost $250,000 in legal fees, Shaw said, Shaw, Asarco plant manager since 1985, said he is disappointed and frustrated by the opposition: "We thought we had a win situation." El Paso environmental groups, chambers of commerce and city and county governments support Asarco's plan. Sen. Peggy Rosson, D-El Paso, and Rep. Jack Vowell, R-El Paso, also urged the board to approve, the permit "I agree that in a perfect world we would not have a smelter adjacent to Downtown and the university, The facts are that El Paso grew up around the smelter. It is there.

It is a major employer, and it is going to stay," Rosson said. Losing Asarco and its 500 El Paso jobs would mean a loss of about $330 million over 10 years and cause more El Pasoans to turn to the state for human services, Vowell said. Hool "It is incomprehensible to me why anyone would object to technological modification providing significant improvements, not only in the plant's air quality emissions -but in its financial viability," Vowell told the hearing examiner.
