El Pcco Hcdso 42B El Paso Times Wednesday, March 18. 1992 Asancb negotiates on permit request: 1 Gift i i i i Artist wants bins moved from mural City Council approves grant to restore mosaic By Joe Olvera El Paso Times The- Senor Sol mosaic mural created 10 years ago by El Paso artist Mago Gandara tq honor energy conservation is now hidden behind recycling bins and a fence at the El Paso Environmental Center and the artist wants something done. "It's sad that the beautiful mural, which represents humanity, stands in danger of being lost among the recyclable bins and being ignored by El Pasoans," Gandara told members of the El Paso City Council Tuesday. Gandara asked the council for a $2,000 grant to restore the mural and urged city representatives to move the bins and fence blocking the mural. The council approved the grant but took no action on Gandara's second request.

The huge mosaic covers a wall at the Environmental Center, 800 S. Piedras in South-Central El Paso. The artwork depicting a man embracing the sun and Earth was commissioned when the building housed the city Energy Center that promoted alternative energy. The mural, consisting of hundreds of small tiles, is made from black volcanic rock from New Mexico, red rock and crushed seashells from Mexico, Italian tile, European glass and other materials. The Environmental Center, which opened about a year ago, has offices for the Sierra Club, Habitat for Humanity and the Audubon Society.

Asarco: smelter's $81 million modernization project, huddled with company officials Tuesday night to negotiate a possible settlement that could prevent a two-week hearing before the Texas Air Control Board. Asarco wants to increase copper pro- duction from about 100,000 tons to 168,000 tons per year rwith new pollution-control equipment, which the company says will cut pollutants by about 45,000 tons. But Piiion said he is fighting the plan because the 104-year-old copper smelter is not doing enough to clean up El Paso's dirty air.

Piiion filed an objection to Asarco's permit request with the -Texas Air Control Board. Air Control Board hearing examiner BUU Ehfeti'recessed a hearing, on Asar-. co's permit application to give Pifion and smelter officals a chance to pursue a settlement. "If don't have any feel for it. We would love to have a settlement if we can get something concrete," Asarco Plant Manager John Shaw said during a break in the closed-door negotiations.

"I'm sure that if it's reasonable and we can agree to it then we could settle it." Piiion would not say what conces-, eions he wants. "It's an international matter; it's not just El Paso because there are people across the river from Asarco less than 300 yards with heavy concentrations (of Pinon said. Asarco says the new technology will lead emissions by 32 percent from 20 tons to 14 tons per year. -They aren't reducing enough. Opposition is they should be reducing it more-," Piflon said, citing stricter stan-.

dards by the Centers for Disease Control. vv Safe thresholds for lead are unknown, Piiion said, His opposition has caused a contested case and cost Asarco millions of dollars. Interest on the company's $81-million purchase of the equipment from Germany and Finland runs nearly $1 million a month, Shaw said. The company could have had the equipment installed and running at least three months ago. The delay could set the company's plans back by at least 15 months" and Cost $250,000 in legal fees, Shaw said; Shaw, Asarco plant' manager since 1985, said he is disappointed and frustrated by the opposition: "We thought we had a win-win situation." Afterward, Pifion called Vowell's remark "slanderous because; he doesn't know the issues, and how can you say that unless you talk to both sides?" And moving the fence would create more problems, she said. "If we remove the fence, we're opening both the building and the mural to vandals," Mahlow said.

"We did locate there for recycling efforts. There's no way we could function if we didn't have the fence." But Gandara said the mosaic shouldn't have to compete for attention at the city-owned center. Sierra Club Chairman Ted Mertig said the original goal of leasing the building from the city was to establish a recycling center. "If we have to go out of the recycling business, then we would have to withdraw from our lease. We would to find another location," he said.
