Robert James Schibline, 35, was ng held here today in connection with the robbery of the Pewaukee State Bank at Merton, Ray J. Abbaticchio, specia agent in charge of the Charlotte FBI office, said Schibline was arrested yesterday "without incident." The FBI said Schibline, who had boasted, "They'll never take me alive," was carrying a .3 caliber revolver and a .45 call ber Colt automatic pistol. Schibline had $2,586.49 when arrested. He was arraigned be fore U. S.

Commissioner T. Hon here and placed in the Cumberland county jail in lieu of S25.000 bond. The bank was robbed of $4,734 by two men on the morning ol December 13. A second man charged in connection with the robbery, Roy Norman Kuehl was arrested in St. Louis three days after the robbery.

He had $738 on him, the FBI said. Charlotte Cop Slays Negro In Gun Fight CHARLOTTE Charotte police officer killed a Ne- man and was believed to mve wounded another a gun battle here last night. Lt. Neal Forney, the officer, said the dead man is believed be Lawrence Oaston, about 25. The identity of the other man was not known.

Police said the two men were solicitors for a ring of Negro prostitutes. Forney said Gaston was one of several men under pbserva- by police for several days, said he met Gaston and that Gaston solicited him, saying was a woman available. The two walked several blocks until they reached a railroad where a third man halted "That's a cop," the other man told Gaston, Forney related. He said the unidentified man then shot at him from a distance of ess than 10 feet. Fo.rney returned the fire.

The boy died last Wednesday with a bullet In his heart as he ate lunch with his aunt, Mrs. Georgina P.

Diaz, 23. Three other children were at the table in the Brooklyn apartment. Mrs. Diaz and other relatives told police Felipe had been struck by a bullet that came through a window. While the search went on for a possible sniper, fragments of the shattered window were taken to the police laboratory.

A technician reported that microscopic examination' showed the window was broken from the inside. After further quizzing of Mrs. Diaz, police said, she admitted waving a revolver as a joke to make the children eat instead of dawdling over their food. "I thought the gun wasn't loaded," Mrs. Diaz said yesterday.

"I pointed the gun first at my own girl, Judith, 7, and pulled the trigger. "Then I pointed the gun at Felipe and pulled the trigger again. It fired. I didn't know it was I didn't know that!" Also at the table were two other Diaz children, 3, and Pablo, 4. Police gave this further account: Mrs.

Diaz' husband, Juan; 33, used a knife to shatter the window as though a bullet had entered from the outside. An-' other relative, Sylvester Santiago, took the death gun on the Staten Island ferry and dropped it into the bay. Mrs. Diaz was booked on a 1 homicide charge. Her husband' was charged with illegal possession of a weapon; and Santiago was charged with acting la concert with Diaz and destroying evidence.
