Another big freeze for Marfa today at 4:30 in the afternoon, the thermometer registered 36 degrees, and rapidly growing colder. Tuesday night the various Halloween parties, phantom processions, gave the streets of Marfa such a spooky, uncanny appearance that one involuntarily thought of the lines from Hamlet, "Tls now the very-witching time of night, when church yards yawn, and hell itself breaths out contagion to this world." But it was all kindly, good-natured fun; no rough nor malicious tricks were Indulged in. Miss Calloway entertained the little folk of the primary department of the public school at a phantom party, at the home of Mrs. Jorden. After a few games the little spooks, with Jack-o-lanterns, paraded the streets and had lots of fun.

A halloween party wag enjoyed by a large crowd of young people at the home of Mrs. M. It. Mahon. Mrs.

L. W. Roberts entertained at a phantom party, some of the older young people. A merry evening was spent. The Marfa Literary Club entertained at a typical Halloween party.

All the usual games were enjoyed, such as fortune telling, apple ducking, etc. After which, a salad course was served. The Marfa History Club entertained their husbands Tuesday evening at the home of Mrs. II. M.

Perwell. This was by far the most elaborate affair ever given in Marfa, and was enjoyed by all present. The house was decorated In Chrysanthemums, oak leaves of all the beautiful autumn hues, black cats, bats, jack-o-lanterns were grinning from every comer and crevice, witches were also, and skeletons, devils; in fact eveerything calculated to make the hair stand on ends. There was plenty of good music, and some amusing contests: one of which, was the "broad-smile" contest, the prize In this was "smilingly" carried off by Mr. M.

Porter, the prize was a book of "Ghost Stories." Fortunes were told by "witches" in costume, witches' brew was also served from a "caldron." There were "majic fruits" which upon being lighted, exploded. sentence of the court. Affidavit of Ilrady and Majors. The Htate of Texas, County of Midland. lsaacks, Judge of the seventieth judicial district of Texas, do solemnly swear that I presided at the trial of the case of the State of Texas vs, Leon Martinez, in the district court of Reeves county, Texas, July, lail. and that In the trial of said case the defendant was given every opportunity that he requested or that bis counsel requested, to obtain evidence as to his ago, or tj desprove his guilt; that everything possible was done to give hlin, the defendant, a fair and impartial trial; that the attorneys, one of whom was appointed by the court immediately on the bill of Indictment being returned Into court, to defend the case, Judge J. W. Parker, an eminent attorney of 1'ecos, who was afterwards employed by defendant and paid a fee to represent him, and the other, the Honorable George Kstcs, of Kl Paso, who was also employed to represent the defendant, were given tin opportunity to secure testimony, and ere granted everything that they asked. Neither the 'defendant nor either of his attorneys asked for a postponement of the case in order to secure more testimony; neither the defendant nor his attorneys requested a private, audience among the defendant and his attorneys, but his attorneys did request an audience with the defendant and the court instructed a Texas ranger pres-ctnt to remove the defendant into private room, where his attorneys might consult with him, which was done, and no objections were made by either the defendant or his attorneys to said ranger being present during the Interview.

The defendant was given all Will P. Hrady, district attorney of the seventieth Judicial district of Texas, and Lester C. Majors, official shorthand reporter of the said sev entieth judicial district of Texas each of whom being by me duly sworn, on his oath deposes and says that he has carefully read over the foregoing affidavit made by S. Parker said substantially to the Jury that the defendant, Martinez, had had a fair and an Impartial trial, that the court had granted to the defendant practically everything asked for, and that the attorneys for the defendant had no complaint to make at the court, and that when we, the Jury, had returned a verdirt Into the court, regardless of what said verdict was, that they, meaning the attorneys for the defendant, would be satisfied with said verdict. At first It was thought Bordwell was uninjured but a case of nerves, brought on by the shock of the accident were too much for him and he died Saturday night. While standing before a fire in her home mt Ramah, Edith, the eight-year-old daughter of Mr. and Mrs. Lewis, received such a severe burning that she died within a few hours. In some manner the little girl's clothing caught fire and before anyone could render assistance she was so badly burned she could not be, saved.

Los Angeles will wave an official adieu to the Pacific fleet tomorrow afternoon. The disposal began in reality today when the smaller craft torpedo boats and destroyers left for San Diego. Shortly afterward the protected cruisers Cincinnati, Kaleigh and Buffalo steamed for Mare Island, where the former two will be prepared for a trip to the China station, next the armored Maryland steamed for San Diego, followed by the tender Iroquois, and the submarines Grampus and Pike. Early tomorrow the cruisers Colorado and West Virginia will start southward, followed by the Glacier and Prometheus. Then Admiral Thomas will board hi- flagship and at p.

m. the South Dakota, the old battleship Oregon and the armored cruiser California, will "round the point" and he gone. Their destination, too, will be Ssn Diego. showers of beautiful, mlnature fruits, flowers, and birds. After enjoying all these, a two-course luncheon was served, consisting of chicken salad, pear salad, cheese straws, olives and black coffee, served in china pumpkin-face cups.

This was followed bv ice cream with candled violets and cakes. It was an evening long to be remembered. Wednesday afternoon Mrs. H. M.

Fennell waa hostess to the Guild of the Episcopal church. After the program a salad course followed by ice cream and cake were daintily served. John Maurer is spending a few days with his parents and friends In Marfa. John Is now employed by the Cande-1111a Wax Plant. Messrs Breeding and Booth went to Sierra Blanca, thence to the Wax Plant this week.

O. Hubbard, leave today for Mexico to Join Harry Hubbard, m-ho is with one of the mining companies in that country. Mra F. M. Poole will occupy one of the Love cottages this winter.

We ar? slightly suspicious of a the time that he asked to prepare for trial. No request was made for a postponement of the trial of the cause, either before announcement of readv or during the pendency of the case; neither was a change of Venue asked for by the defendant or his counsel. All the time that was asked by the attorneys was given for the argument of the case. Judge J. W.

Parker, of Pecos, In discussing tho case before the Jury, used to the Jury, In substance, the following language: "Gentlemen of the Jury; The defendant has had a fair and Impartial trial. We have nothing to complain of In the trial of the case, nnd vhen you have rendered your verdict we will be satisfied." After the Jury had rendered a verdict, finding the defendant guilty and ansesstng his punishment at death, the defendant's attorneys prepared and filed a motion for a new trial, which motion for a new trial was signed by both the attorneys. Judge J. W. Parker of Pecos, and the Honorable George Estes of El Paso; and th court, after due consideration of said motion, overruled same, and in open court, in the presence of the district attorney, the oifnial shorthand reporter, and others, asked Judge J.

V. I'arker, one of defendant's counsel, if h- desired to give notice of appeal. The said Judge J. W. Parker, then and there in open court, announced that there had been no error committed in the trial of the case, and that it was useless to take an appeal, and that the attorneys, meaning himself end the Honorable George Kstes.
