We regard the maintenance of many of these stations as necessary to meet the reasonable requirements of the traveling public, notwithstanding that commuters accustomed to use of them have had to use other facilities since all of the 88 stations were closed in July of 1938. Timetables for Stations Which "Must Be Reopened Following are New York, New Haven Hartford timetables issued by the State Public Utilities Commission for compliance by March 10 in the restoration of service (approximate Eastern Standard Time at stations): DORCHESTER LINE that would be required to service the reopened stations. The decision, prepared by Commissioner Richard D. Grant, apparently brings to a conclusion litigation and lengthy proceedings that started more than two years ago.

In November, 1937. the first abandonment petitions Were filed. At about the same time the trustees sought reorganization in the Federal Court. While the abandonment petitions were still pending, the railroad shut down the 88 stations on orders from Judge Carroll C. Hmcks of the Federal District Court New Haven.

The action raided the issue whether or not the State Utilities Commission had final authority on abandonments of stations. by the results of our own independent investigation, although we have taken into consideration also the fact that we have now before us evidence of revenues and expenses assembled by the petitioners which was not made available in the proceedings leading up to our order of Nov 28, 1939. The stations which the commission directed should remain closed follow: Bass River, North Harwich. Pleasant Lake. Brewster.

The Baptist Religious Society will receive $5000; $1000 each to the Hale Hospital. Haverhill, Old Ladies Home Association, Haverhill, Y. M. C. Haverhill, Haverhill Public Library, and Haverhill Day Nursery Ihe sum of $4000 will go to bbot Academy.

Andover; $2000 to the William M. Comcau Post, A. Hav. erhill, and $500 to the Haveihill His-tcrical Society. The residue to go to the Haverhill High School for scholarship funds.

"Moreover, the geographical relationship of many of these stations to adjacent stations which will be reopened is such that the communities which they represent cannot with complete accuracy be said to be without service. Some of them are situated at distances apart no greater than a few hundred feet, as the case of West Roxbury and Spring-st.

Dever appealed the Hincks ruling, and won before the Federal Circuit Court of Appeals. The question then went to the United States Supreme Court and Justice Felix Frankfurter upheld the Circuit Courts finding. Last November, with its authority established, the Public Utilities Commission issued an order requiring the restoration of service at most of the 88 stations, but on petition of the railroad trustees the time for the execution of the order was extended to March 8. Meanwhile the trustees were successful in having the commission reopen the hearings so that more evidence might be introduced as a possible basis for a compromise. Commissioner Grant, referring to the reopened hearing and the testimony and evidence gathered, said: "We are still unconvinced that there is a sufficiency of petitioners evi-, dence before us to the granting of written authority for abandonment of stations and curtailment Road Repair Sums Going to 176 Towns The sum of $1,343,250 will be distributed among 176 Massachusetts towns with less than $5,000,000 valuation for the maintenance and repair of local roads, the State Board of Public Works Commissioners announced yesterday.

The distribution is done annually under Chapter 81 of the General Laws. Commissioner Beal has announced part of the money may be used by the towns as a sponsors contribution to a W. P. A. project for the construction of farm to market roads.
