FBI Is on Spot By JAMES MARLOW Associated Press News Analyst ' WASHINGTON (AP) — The government has its hands full with Harvey Matusow, who says he would do anything "for a buck" and has just pulled a big switch. With his own membership In the Communist party as background, the 28-year-old Matusow since 1951 has been testifying under oaUi before federal grand and trial juries and congressional committees about communism. Now he swears under oath that the previous testimony he gave under oath was a lie. He says his switch now is a matter of conscience. He says he mdae a racket of being a witness, getting money and publicity for it. It might seem since Matusow now says he perjured himself, that the government without any difficulty could haul him into court Instantly, uste against him his own admission that he lied, and convict him of perjury. It isn't that easy. Onder the law the government can't convict a man for perjury unless it can prove, by witnesses or other evidence, that he lied under oath. His own statement under oath that he had lied under oa th is not enough to convict him. And that naturally raises a question — for the government a very important question: When did he- lie, now or in the past? Malusow swears now he gave false testimony in the trial of 13 second-string Communists convicted In New York and in the trial of a labor leader convicted in Texas of lying when he took a non-Communist oath. Unless the government can prove that Matusow is perjuring himself now — and therefore that he told the truth in the trials — the 13 Communists in New York and the Southwest labor leader may get new trials. If the government can't prove that Matusow was telling the truth In those trials — and therefore lying now — the Justice Department faces a question about Its own operations: Just how much effort did make, before using Matusow as witness against those H people, 1 be sure lie was telling the truth'; Matusow joined the Communist party in 1947, was an FBI informei in the latter part of 1960 ,and, sup poscdly, although this has been questioned, was expelled in January 1951.
