Reversing a groundbreaking opinion, a federal appeals court ruled that a man convicted of rape in 1990 does not have a constitutional right to DNA testing on evidence. The three- judge panel of the 4th U.S. Circuit Court of Appeals found unanimously Wednesday that James Harvey failed to prove the Fairfax County prosecutor violated his civil rights by refusing to allow tests on evidence from Harvey's rape and sodomy trial. "Such relief (DNA testing) must be conferred by either state or federal legislation or by the state courts acting under their own constitutions," the court said. Lambert breach delays many flights A man carrying a computer bag bolted past security and remained at large two hours after exiting into the concourse.

Associated Press ST. LOUIS A man carrying a computer bag bolted through a Lambert Airport security checkpoint Thursday, prompting officials to evacuate the concourse. The man remained at large more than two hours after he passed through an exit in the concourse, bypassing security, said Lambert Police Chief Paul Mason. The breach prompted American Airlines to remove passengers from about a dozen flights and have them rescreened, said Julia Bishop-Cross, a spokeswoman for the airline. Another 10 flights were delayed, she said.

The concourse was reopened about two hours later. "With all these guys at' security, how come they couldn't run and catch them?" said 63-year-old Pete Bucki of Raleigh, N.C., who was headed to Las Vegas. "Someone went through here and they can't catch him? That's ludicrous." Mason said National Guard troops at the checkpoints were helping monitor the screening process, and "they're not focused on the exit Flier calls radio about his knife, is arrested By Liz Sidot Associated Press COLUMBUS, Ohio A judge set a $500,000 bond Thursday for a man arrested by airport police after he called a talk radio show and said he had boarded a plane with a knife concealed in his belt. Robert Hedrick, 37, slouched against a wall during his hearing, his hands handcuffed in front of him. He is charged with carrying a weapon aboard an aircraft, a felony.

"This is not a time to be seeking publicity, Mr. Hedrick," Municipal Court Judge W. Dwayne Maynard said. Hedrick, of' nearby Delaware, Ohio, called the Columbus talk show on Wednesday and said he had inadvertently boarded a US Airways flight in Greensboro, N.C., with a 3-inch knife hidden in his belt, said Angie Neal, a spokeswoman at Port Columbus International Airport. She said a listener notified authorities.

Hedrick's flight had a layover in Pittsburgh, but he did not have to pass through security there, Neal said. Hedrick called the show from the Pittsburgh airport and again from the plane after it touched down in Columbus, program director Steve Konrad said. He said there was nothing sinister about the call. "We had no idea there was anything other than surprise and dismay on his part," Konrad said. "He wasn't bragging like all those bozos are saying.

According to Konrad, Hedrick said he noticed the knife was part of his belt buckle during a trip to the bathroom. Columbus airport police officer Troy Mills said officers decided to check the belt buckles of all males getting off the plane. He said Hedrick told police he was the man they were looking for. After the hearing, Mills said Hedrick indicated he had called the station to get advice on what to do. Konrad, the program director, said Hedrick told the show's producer, "I've just got to tell Hedrick lives on a farm, and the telephone there was busy Thursday.

He works for a medical distribution company and has a second job as a township zoning inspector, police said. John Bronson, a spokesman for Arlington, US Airways, said the airline was aware of the arrest but details would have to be obtained from police. Police at Piedmont Triad International Airport in Greensboro declined to comment. Authorities searching for 144 stolen guns Associated Press BELLEVILLE, Ill. Investigators in the St.

Clair County Sheriff's Office are trying to find 144 guns from simple handguns to semiautomatic weapons that are on the street after being stolen from a storage room at the local courthouse. Authorities say an East St. Louis man who used to clean the building stole five of the guns earlier this month and was arrested walking out of a storage room in the Circuit Clerk's Office allegedly with weapons in his hands. Two other guns were found by nearby police agencies, but investigators say they don't know where the 144 other missing weapons are. The guns, which had been confiscated by police in cases already resolved, were stored in unlocked cabinets in a room secured by a simple key lock, said St.

Clair County Circuit Clerk C. Barney Metz, who is responsible for storing the weapons. They were hauled away to Granite City Steel every two years to be melted down, said St. Clair County Sheriff Mearl Justus. An office worker, LouAnn Henry, said she took inventory of the weapons every year, the last time in August, when each was accounted for.

But in early December, when a police department requested a few of the guns, Henry noticed some were missing, she said. She eventually counted 151 Florida Garden Gift 442-3525 Sale Off Christmas Merchandise (excludes Fontanini) 812 Old Mayfield Paducah, KY www.floridagardencenter.com 02 guns missing from the room, and sheriff's deputies set up a video camera in early January that resulted in the arrest of 34-yearold Joseph Williams. He was charged with burglary and possession of a firearm by a felon, and was being held in the St. Clair County Jail. Williams had been convicted in 1995 of aggravated battery.

When asked if Williams was considered a suspect in the disappearance of any of the 144 other guns, Sgt. Dave Thornton of the St. Clair County Sheriff's office referred questions to prosecutors. St. Clair County State's Attorney Robert Haida did not return messages.

Williams worked for Foley Chemicals and Machines a 50- year-old Caseyville firm that has contracted with the St. Clair County Public Buildings Commission to clean the courthouse for the past eight years, said its owner, Art Foley. The supervisor of the county's buildings, Darius Monken, also did not return messages left at his office Thursday by The Associated Press.
