CAPITAL GROUP EXPANDING IN REGION The Capital Group announced Thursday it would open 15 new offices this year. The offices will be in branches of Old National Bancorp in Indiana, Illinois and western Kentucky.

The Capital Group is a regional brokerage firm with 200 offices in 24 banks in Kentucky, Illinois and Indiana. Industry lauds, consumers pan deregulation bid BY MIKE MILLS THE WASHINGTON POST WASHINGTON The seven regional Bell telephone companies, the long-distance industry and cable television operators generally applauded the Senate Commerce Committee's broad bipartisan approval Thursday of legislation that would deregulate their industries.

But Vice President Al Gore and two leading consumer groups criticized parts of the bill, saying it could result in higher cable and telephone rates. They said they would work hard to alter it. The committee voted 17-2 to send the measure to the Senate floor. Senate Majority Leader Robert Dole, has said he will try I to bring it to a vote quickly. The bill aims to replace regulation with competition in the communications industry by breaking down the patchwork of laws that bar telephone companies, cable companies and broadcasters from entering one another's industries.

The Bells are the most pleased with the legislation, because it would allow them to offer longdistance and cable TV service more quickly than would have been possible under unsuccessful Democratic bills of past years. Executives in the long-distance industry, led by giants MCI Communications Corp. and Sprint were pleased the Bells will not be allowed into their markets on a predetermined date. Instead, the Bells will have to meet a checklist of conditions for opening their local telephone markets to competition before they are allowed to offer long-distance Long-distance companies succeeded in getting lawmakers to weaken language late Thursday that would have limited their ability to offer local phone service immediately. The two votes against the bill came from Republicans Bob Pack-wood of Oregon and John McCain of Arizona, who said the bill did not go far enough in deregulating.

They were particularly upset that committee Chairman Larry Pressler, agreed to keep some rate controls on cable TV operators a move Pressler made to win the votes of committee Democrats. In the end, Democratic senators agreed cable operators would continue to be barred from raising prices only on subscribers' "basic tier" of programs, which include over-the-air broadcast and public-access channels. For other topes of programs, cable operators rates would be unregulated unless they exceeded a "national average rate" for comparable cable shows. Though committee Democrats voted for the bill, it drew criticism from the Clinton administration. In a statement, Gore said he was concerned that consumers would not benefit.

He singled out the cable rate compromise, which he said "will lead to unjustified rate increases for cable subscribers." Gene Kimmelman, co-director of the Washington office of the Consumers Union, which publishes Consumer Reports magazine, said the cable rate relief, combined with provisions that allow cable companies, broadcasters and telephone companies to buy one another out, will result in price gouging and large-scale concentration of media companies. That view was also expressed by the Consumer Federation of America. "This legislation will invite a new generation of robber barons to dominate both telecommunications and media markets," Kimmelman said. Their effectiveness is being debated within and outside the legal profession.

Sear's action in such a high-profile case may "force both plaintiffs' counsel and defendants to be more careful in the future," said Arthur Bryant, of Trial Lawyers for Public Justice, a public interest group funded by plaintiffs' lawyers. The settlement that Sear rejected called for Bronco owners to receive the warning stickers to be affixed to their vehicles' sun visors as well as a "utility vehicle video," a supplement to their owners' guide and a free inspection. Sear excoriated the lawyers representing the Bronco owners for seeking $4 million in legal fees, which ne called "exorbitant." He wrote that the deal struck by the Bronco owners' lawyers, and Ford's failure to object to their fee request, combined to taint the proceedings "with an appearance of impropriety on the part of" the vehicle owners' lawyers. In a statement Thursday, Ford defended the proposed settlement. BY SAUNDRA TORRY and WARREN BROWN THE WASHINGTON POST A federal judge in New Orleans has thrown out a proposed settlement to a class action lawsuit involving claims that Ford Bronco 1 II vehicles are vulnerable to rollover crashes, asserting that the deal Was "of little or no value" to Bronco owners.

In the settlement proposed by Ford and lawyers representing about 680,000 Bronco owners, the automaker had agreed to distribute stickers and other safety information to Bronco owners. But U.S. District Judge Morey D. Sear said in his ruling, issued Monday, that the deal fell so far short of what Bronco owners had sought that it was unfair and inadequate. Sear disclosed that Ford has paid $113.4 million to settle 334 lawsuits filed by consumers who had claimed that its Bronco II sport-utility vehicles killed or injured people in roll-over crashes.

Sear reasoned that Ford's willingness to pay out "significant settlements" indicated consumers would "have a reasonable chance" to succeed if the class-action case went to trial. West Kentucky State Technical School Rusty Jones of Mayfield prepares to take his Kentucky Board of Barbering license examination. State board unnerves 4 barber candidates STAFF REPORT Mayfield resident Rusty Jones tried to remain calm as he laid out various barbering supplies before the "big" exam. Not only was he about to put to the test barbering skills he'd learned during several months at West Kentucky State Technical School, but he was about to take the State Board of Barbering certification exam under the watchful eyes of more than 20 of his classmates. "I'm nervous," he whispered Tuesday before the two-hour test began at West Kentucky Tech.

Neither Jones nor the three other West Kentucky Tech barbering graduates needed to worry. Jones, Debbie Henson of Benton, Wanda Travis and Sean Viehe, both of Paducah, all passed their average overall score ranking among the highest the board has ever had for a single testing date. It was the first time the five-member state board had ventured into a school to offer the apprenticeship test. The Kentucky State Board of Barbering normally offers the national certification test at its Louisville office every five weeks. Students must'pay a $100 fee.

Graduates of West Kentucky Tech's barbering program have scored the highest on the national certification test for four years. Instructors Howard and Jack Faughn were recognized last week by the state Board for Adult and Technical Education for the program's success. The school's record, though, had little to do with the board's decision to offer the test here, according to Board Administrator Douglas Clapper. "I feel it's very good for current students to see how the test is given and all the ins and outs that go into it," Clapper said. "We want to be people-oriented, and this is just one way to do that." Board members Larry Doyle of Brodhead and Jane Carpenter of Bowling Green were the judges in Tuesday's test.

Carpenter said the state board administers two types of tests: the apprenticeship test for students who recently graduated from an accredited barber school in Kentucky and the master's test for individuals who have their apprenticeship licenses and have worked 18 months as a barber apprentice. During the apprenticeship test, students have 30 minutes to complete a multiple-choice written exam and an hour and 20 minutes to do a shampoo, haircut, shave and facial on a live model as well as show their knowledge of doing a perm, coloring and straightening hair demonstrated on a mannequin. Clapper, a barber with 30 years' experience, said he understands students' anxiety about certification tests. He added there is no reason for anyone to be afraid of the State Board of Barbering. "That's why we've been trying to go out to the people.

We want them to know what we're all about and that the agency is not something to be afraid of," he said.
