(AP) The husband of a 24-year-old woman who gave birth to a healthy baby while she was comatose has filed suit seeking to disconnect the young mother from a hospital life-support system. The suit, filed by Charles Evans 'on Friday in Douglas County Circuit Court, seeks legal permission to remove Julie Ann Evans from a "volume respirator," without which she has been unable to breath for long- er than five hours Although the suit names Mrs. Evans' physician, Dr. Sergio Cervi-Skinner, and Douglas Community Hospital among the defendants, the doctor and the executive committee of the hospital's medical staff favor ending the life supports, according to affidavits filed with the suit. No date has been set for a hearing on the suit.

Mrs. Evans, a nurse, has been in a coma since suffering a cerebral hemorrhage on Oct. 26, 1981. Early that day, Mrs. Evans told her husband that she had a headache.

She lost consciousness about 20 minutes later. Emergency brain surgery was performed and doctors said Mrs. Evans had severe brain stem damage resulting from a congenital deformity. Despite the coma, Mrs. Evans gave birth by Caesarian section on Feb.

25 to i healthy. 7-pound, 13 ounce baby, Doctors were surprised not wealth of Pennsylvania in the amount of Eigth Dollars and only that the baby lived, but that she suffered no birth defects from the medications her mother received. Since her birth, Jennifer has been cared for by her aunt and uncle. Doctors say Mrs. Evans' condition has not changed Since Jennifer's birth, and there is little chance she will emerge from the coma.

"In my opinion, there is no reasonable possibility that she can ever again return to a cognitive state," Cervi-Skinner said in an affidavit. "In light of this prognosis, and in the absence 'of arfy possible treatment, I believe that it is proper to discontinue the life-supporting respirator." In another affidavit, Mrs. Evans' mother, Betty Bell of Tri City, said, "In light of these circumstances, my family and I agree that the use of the life-supporting respirator (should) be discontinued." The suit asks the court to declare that Mrs, Evans has a "constitutional right of privacy which includes the right to decline medical treatment when there is no reasonable possibility of returning to the cognitive state." 1 The suit asks the court to declare that "participation by any person in discontinuance of life support measures shall be without any. civil or criminal liability." hOrty-Eigh!
