P. Boyd, in 87th dis- i trlct court here, granted the mo- tion for a new trial presented by Lester Shepherd, defense attorney. County Attorney Carl Cannon did not oppose the life sentence. Burton was sentenced. He is also under a 75 year sentence in Navarro county.

Burton plead guilty in the Thirteenth Judicial District Court here several weeks ago and was given 75 years for his participation in, the robbery of the First State Bank i of Richland. Oct. 12. He also was given 2 years for alleged auto theft in connection with the theft of the auto belonging to Harry i Miller of Corsicana. c.

C. Howe was given 99 years in hia trial in Corsicana for robbery of the Richland Bank. He did trot plead guilty. Dock Potter, the third man, entered a plea of guilty and Mas given 25 years for the bank robbery and years for auto theft. The three men were carried to Grosbeck several days ago to face I auto theft indictments there, Bud Russell, State penitentiary was in Corsicana Monday en route to Huntsville with 26 prisoners and was advised that Howe, Potter and Burton were ready to go to the penitentiary.

He stated that he would return to Gioesbeck Tuesday for the three men to take them to Huntsville.
