Defendants in the suits, filed in federal court here last month, are Halifax Paving, Inc., of Daytona Beach and Joseph W. Mange Jr., Inc., of Jacksonville. Lowery Bros., Inc., of South Daytona and John Barton, a former ITT-CDC employe, are accused of conspiring in the scheme but are not named as defendants. In each suit, ITT-CDC states that at the present stage of its investigation it can only estimate damages at $1.5 million but says the $3 million total could grow. Each suit asks the court to allow discovery of further losses. An attorney for Leonard Durance, president of Halifax, has filed a counter suit against ITT-CDC for breach of contract, and Mange's attorney has filed a motion to dismiss the two suits. The Maimi-based subsidiary of ITT alleges in the suits that Durrance and Joseph Mange conceived a scheme in 1971 to pay off Barton "and possibly others." The suits allege the companies did "eventually put them on their payroll and-or provided them with gifts and other items of substantial value." Those who had been "compromised" by payments saw to it that Mange, Lower}' Bros, and D u r r a n c e got "numerous, lucrative contracts," the suits allege, and were able to gain unwitting ITT-CDC approval of unnecessarily high prices. The suits allege that Barton, former field engineering supervisor at Palm Coast, a massive ITT subdivision in rural Flagler County, received kickbacks of at least $220,000 from contractors doing business at the development. The suit says that because of the conspiracy, allegedly carried out between 1971 and 1975, a monopoly in some critical areas of construction was created, competitive bidding was eliminated and the free market was upset.
