Nitroplyeerine. Tai. Pitch. Rosin and other combustible and tufluminstlVlu materials Be it Ordained by the Common Council of the town of Yuma: Section 1. From and after the' passage and publication of this Ordinance it shall be unlawful for any person, firm or corporation to have in possession cr keep in storage within the limit of the town of Yuma any blasting-powder, gun-cotton, nitroglycerine, dynamite, giant-powder, or any other like explosive.

Section It shall also be unlawful for any person, firm of corporation, within that portion of the town of Yuma bounded on the north by a line parallel to and south of the Colorado river and one hundred feet from low water mark, and on the south by Third street, and on the cast by Gila street, and on the west by Mndisnn nvenne to onen. "keen or maiiftain anr lumber-yard, wood-yard, coal-yard, or hayvarapi or market or plate where any Iflinbcr, rood roal. hay, tar, pilch, resin, or crude petroleum is kept for sale or stored. Section 3. The provisions of section 1 of this ordinance shall not extend to persons having in possession small quantities of the articles mentioned iu said section 1 for their own lawful and immediate personal and individual use.

Bat such per.sous having such small quantities of wiid articles in possession shall speedily and without delay use the same and during the time they shall have sueh articles in possession they shall carefully protect and handV the same so that no damage to the person or property of others result therctrosn. and immediately upon the completion of the use of such articles the residue thereof shall be transported beyond the limitof the town. Section. The provisions oi section of this ordinance hall not exteid to persons. liFm.s or corporations having in.

possession sueh quantities of the articles mentioned in said section as ihey may need for their immediate personal, private aud individual use, nor to keepers of livery or sale stable or feed sta bias, yards or corrals having or keeping in their places of business aud for use therein not more than fifteen tons of hay at any one time. Section 5. It shall uKo be unlawful for any person, firm or corporation to have iu or keep in storage within the limits of the town of Yuma more than twentyflve pounds of gun-powder at any one time Section 'C. Every person, firm or corporation who shall violate any of the provisions of this ordinance ordo sny of the things herein declared to be unlawful shall on conviction thereof be fined the sum of twenty-five dollars antf costs of suit. And if after such conviction such-person, firm or" corporation shall continue to violate the provisions of this ordinance or shal? continue to do the thing of which he shall have been convicted for a period of twenty-four hours then such person, firm or corporation shall on conviction thereof be lined in the sum ot twenty-live dollar and cots of suit.

And a-lihe fine and cots may be imposed upon con' viction of such violation or continuation of such offense for every twenty-four hours threat lev that such person, firnror corporation shall continue to do the thing of which he shall have been convicted. Section 7. All fines wftieh may accrue under this ordinance shall be recovered by aclioa of debt as-prescribed in Soction 1 of Article VIII cl Chapter 0 of Title 1 1 of the Revised Statutes of Arizona. The first process in all suchac tions bhall be a summons which shall be issued nd served as in ordinary civil action', in the Territory of Ariisona. Such summons may be served by the town aarblwil or a-ny sheriff or eon tabli within thf territory of Arizona.

Section 8. AH judgment, rendered and fines lmpobcd under the provision of this ordinance mav enforced by execution as in ordinary ciril actions in the territory of Arizona. 9. This shall be in force from and after its passage and its publication in. three consecutive issues of the Arhsona Sentinel a weekly newspaper published in the owr.

The board of supervisors having acted upon petitiou of the people of Yuma and according to law appointed a board of councilmen, we hereby turnover all books, papers and property in our hands to said council, all members of which being present, and adjourn sine die after approving these minutes. Devine, John Dunne, Robt. Tapia and F. L. Ewing, having 'been duly appointed as members of the board of common council in and for the town of Yuma, said appointment having been made by the board of supervisors of Yuma county, and said R. S.

Ewing, having! been duly sworn according to law, met ou thc above date at the council rooms and adjourned to the office ol: the Bank of Yuma, where they proceeded to organ- ize. The meeting was called to or- der, and on motion duly made' and seconded, R. S. Patterson was elected mayor. F.

L. Ewing was appointed clerk until such i time as a regular clerk should be duly elected by the council. On motion duly made and seconded and carried unanimously, it was ordered that the report of the board of trustees be accepted. It was further ordered that the clerk be instructed to malre an inventory of all papers, books and other xroperty belonging to the village of Yuma and which now by virtue of the change of government belongs to the Town of Yuma, and file said inventory with the council. On motion it waSjimanimously Resolved: That the office of the Bank of Yuma be, and the same was declared to be, the common council chamber and the place of meet-tag of the common council until the further order of the council.

John Dunne, Robt. Tapia and F. L. Ewing. A contract was presented from the Southern Pacific Company for the construction of a sewer on Main street, and the mayor wras instructed to execute same when necessary changes were made in it.

The election of clerk and marshal was postponed until the first meeting in May, which was decided to be the first Tuesday at 8 o'clock p. m. P. T. Robertson was elected town attorney.

John Stoffelii presented a bill for SJJ5.00, assigned- claim of Monje. The same passed for the present. Report of J. L. Balsz, marshal, reporting $59.00 turned over to treasurer for licenses collected, received and ordered filed.

tJpon motion the marshal is ordered to collect air back licenses. The following bills were audited and allowed: Bill of J. Li. Balsz James Milton F. L.

Ewing, seal furnished to town, J. Li. Rimpau, material furnished for decoration Peter Aune, salary as janitor The bill of the Yuma 1 2 50 1 40 20 00 Water and 78.00, is referred to mayor to arrange rates. Upon motion the clerk is instructed to make bill to E. F.

Sanguinetti of $4.00 for repairing of street and present the sa me. Upon motion seconded and carried, the following salaries were fixed, ro-wit: Office of town clerk, $25.00 jjer month. To the supervisor of streets, the sum of 83.00 per day when actually at payable from the street fund of the town. The following nominations were made: P. T. Robertson was nominated for town clerk, J. D.

Meadow's was nominated for town marshal. Nominations being closed, council proceeded to ballot J. Li. Redondo having received the majority of votes, was declared elected town clerk. J.

D. Meadows having received the majority of votes, was declared elected town marshal. TJ. G. Wilder by a unanimous vote was declared elected street supervisor.

The council then fixed the town clerk's and the town marshal's bond at two thousand dollar's each By a unanimous Vote of the council the following ordinances were passed as read: Ordinance No. I Relating to the seal of the town. Passed as read. Ordinance No. 2 Relating to stated and extra or special meetings.

Passed as Ordinance 3 To prevent the erection of wooden buildings within prescribed limits Passed as read. Upon motion seconded and carried, the mayor is authorized to appoint a committee to contract for the publishing of ordinances and minutes. The mayor appointed J. E. Devine and F.

L. Ewing as such committee. Council then adjourned to o'clock p. May 7, 1902. S.
