Montreal, Friday, February 21, 1986 I r- Anne in a legal battle in Ontario Supreme Court vs. football: No contest i TORONTO (CP) Anne of Green Gables, the CBC's highly acclaimed four-hour mini-series shown last December, has become the centre of a legal imbroglio in Ontario Supreme Court. The two-part, $3-million series which was based on Lucy Maud Montgomery's 1909 Canadian classic and starred Megan Follows, Colleen Dewhurst and Richard Farnsworth was the most successful non-sports program ever aired by the CBC. "I'm really pleased it did so well, but it's sad it had to end up mired in legal controversy. I'm sorry it had to happen in Canada," said Marie Hoy, president of Los Angeles-based Cori and Orient Inc.

The company claims Anne of Green Gables Productions Inc. and Sullivan Films formerly Hun-tingwood Films both of Toronto, have not respected an agreement appointing Cori and Orient exclusive sales agent for Anne except in Canada and the United States for 10 years. Cori and Orient, an international distributor of movies and TV mini-series, claims the companies, owned by Kevin Sullivan, co-writer and director of the TV feature, inter- Oilers at Quebec, the Nordiques on the road in Hartford and the New York Islanders vs. the Washington Capitals. CBC had the Canadiens at home to two top teams, the Oilers and Islanders, and to the hapless Toronto Maple Leafs.

A few more interesting numbers: Channel 12's rerun of the brilliant Television documentary series is averaging a very respectable 22,000 on Saturday mornings at 11; Montrealers still have to wake up to Moonlighting, a great show with a pathetically small audience of Nitelife wins the Friday night pop video war, with 34,000 viewers to 26,000 for Good Rockin' Tonite and 16,000 for Friday Night Videos. DIAL Spinning: Great Performances (Vermont ETV-33, tonight at 9) presents the Dance Theatre of Harlem's jazz ballet version of A Streetcar Named Desire. Tennessee Williams in tights? I guess Blanche DuBois will have to rely on the plies of strangers Keep tuned to Channel 33 for Brown Sugar at 10, a great series on black women singers that will feature the one and only Aretha Franklin and the three and only Supremes in tonight's show Tina on simulcast Tomorrow night's Tina Turner special (CFCF-12 at 8) will be simulcast in stereo on CHOM. The red-hot 90-minute show was taped in Birmingham, England last March using 13 cameras, including a skycam for overhead shots of the great lady's fright wig Saturday Spotlight (CBM-940, tomorrow afternoon at 5:08) salutes the national Theatre School's 25th anniversary and includes reminiscences by NTS founders Jean Gascon, James Domville and current director-general of the school Jean-Louis Roux Loath as I am to ever recommend the dreadful Saturday Night Live, this week's edition of the once-great show (WPTZ-5, tomorrow night at 11:30) might be saved by host Jay Leno and musical guests the Neville Brothers Duelling De Niros tomorrow night: Robert De Niro won an Oscar for Raging Bull (Channel 12 at midnight) and was great with Robert Duvall in the underrated True Confessions (CJOH-8 at Shari Ulrich launches suit against B.C. government CbtfOawtK, Cosby The hand that pops the beer can no longer rules the channel changer.

'Armchair quarterbacks were sacked for a big loss this year "when The Cosby Show drew a bigger Montreal audience than the Super Bowl. The ratings race was close, according to statistics pub-'. lished by the A.C. Nielsen Co. of Canada, but Cosby was the clear winner.

During the three weeks (Jan. 6 Zto 26) that Nielsen conducted a rat- ings survey in the Montreal market, CFCF-12's Thursday evening -telecasts of The Cosby Show 468,000 viewers. The JJan. 26 Super Bowl, in which the I Chicago Bears demolished New England, was on Channel 12 as well and drew an audience of "In Nielsen's national ratings for the week ending on Super Sunday, the Cosby Show had 5.047 mil-! lion viewers to 4.065 million for the football game. And just in case you suspect that the preference for The Cosby Show over the Super Bowl re- fleets our attitude toward Ameri-i; can football, it should be noted that I Cosby's late November ratings were also higher than those for the Grey Cup game.

Bowl big in U.S. In the United States where Rambo defines the national ethos and real men still appreciate the inspiring spectacle of a great foot-t ball team whipping the spit out of a mediocre one the Super Bowl was watched by 127 million peo- pie. It topped the American Nielsens for the week and became the most popular television program in U.S. history, edging past the 1983 final telecast of MASH and its 121.6 million viewers. What can we make of Mont-' realers' preference for first-rate situation comedy over uncompeti- tive football? The superficial conclusion is that Cosbs strength proves the ''city's TV viewers are distinguished by their intelligence, taste and sophistication.

But a more thorough examination of the Montreal ratings book knocks that theory out of the box. Do you figure that Montrealers ''appreciate quality police drama? Steppin' Out averaged 21,000 viewers during the ratings period. Country Report, a terrific little show that CBMT co-produces with the CBC station in Ottawa, averaged Steppin' Out and Country Report are both on at 7 p.m., when they face impossibly stiff competition from Entertainment Tonight on Channel 12, which averages 259,000, viewers for its weekday evening glitz and gossip reports. The most popular locally pro-duced English show is McGowan's World, which averaged1 169,000 viewers on Channel 12.

Dick Irvin's Hockey Magazine averaged 110,000. Friday hockey a hit Speaking of hockey, the latest Nielsen book showed CTV's Friday night package beating the pads off Hockey Night in Canada. The Friday games, which began late last season on CFCF, averaged 322,000 viewers, vs. for the Saturday night Channel 6 games that we all grew up watching. I figured that perhaps the CTV package had lucked into some hot games while Hockey Night in Canada was stuck with a few unavoidable National Hockey League turkeys.

Not so. Viewers who spend their days in front of the box prefer American soap operas (an audience of for Another World on Channel 12) to British ones (only 28,000 watch Coronation Street on CBMT-6). At noon, daytime viewers are more interested in the latest developments in Bedrock than they are in news from the real world. The CBC's Midday, a superior daytime newscast, averages 30,000 viewers in Montreal.

The Flintstones gets 143,000. The weak performance of Midday reflects the ongoing struggle CBC shows face in Montreal, where CFCF-12 is the channel of choice among English viewers. In the battle of evening newscasts, Channel 12's Pulse averaged 399,000 in the January Nielsen ratings, to 99,000 for CBMT's Newswatch. Dynasty tops Dallas The CBC's 10 p.m. NationalJournal package averages viewers and is beaten by Channel 12 every night of the week most conclusively on Wednesdays, when 318,000 Montrealers watch Dynasty.

(It is interesting that Dynasty beats Dallas (265,000) in their English-telecast competition, while CBFT-2's dubbed Dallas edges Dynastie on CFTM-10, 550,000 to 525,000.) GEE! The suit claims staff at the government-run Maples detention centre in suburban Burnaby covered up for the man eventually convicted of the crimes. It alleges that Maples staff "deliberately" did not tell the RCMP that Ronald McFarlane was violent and had previously attacked three women. Ulrich is seeking damages against the government, and five Maples staff members. McFarlane, who was 20 at the time, attacked Ulrich during an institution-sponsored camping trip to Saltspring Island in May 1981.
