The EPA standards in this a were "clearly environmentally unacceptable," said Oliver Williams, acting administrator of the Department of Natural Resources i i i Environmental Standards. The high BOD level combined with high temperatures and a decreased river flow to kill about six dumptruck loads of carp, suckers, bullheads and some walleyes. Williams said Wednesday afternoon that the DNR will have enough evidence in a week to decide whether to take legal action against Consolidated for the fish kill. "There are a lot of factors and we are looking at all of them," he said.

"I think there is a possibility, because of the fish kill, of a charge of some kind." If a large number of game fish are involved, the DNR can fine a violator for each fish killed. There were few game fish in the affected stretch of the river but charges are possible under a statute that prohibits the discharge of. noxious substances into the river. According to Stratton Martin. director of en- i a affairs, discharge which contributed to the fish kill was apparently a "soap" substance comprised of sodium salts compounds, lignin and wood sugars.

The substance floats on the spent liquor. The tanks holding the liquor apparently were more full than normal on July 3. When the mill shut down the liquor flowed into the tanks, overtaxed the receptacles and the liquor overflowed and the "scap" flowed into the river. The mill's tests showed a BOD of 91,856 pounds from Kraft on July 3. Martin said he doubted that the kill would have occurred if I the other two factors had not also been present. The river temperature during the period was about 74 or 75 degrees Fahrenheit and the flow was low 1,750 cubic feet per second.

DNR District Engineer Robert Derksen said the water temperature was not appreciably higher than normal for this time of the year. But it was hot enough to affect the oxygen uptake from sludge in the river, i lowering the dissolved oxygen i (DO) of the river! The flow of the river -was about 1,000 cfs below the i average for this time of the year. The water was being held back upstream in reservoirs because the mills on the river were being shut down for th3 Fourth of July holiday. The three factors combined to lower the DO to .02 parts per million the morning of July 3. It stayed low until 3 a.m.

July 5, and then rose quite rapidly. Derksen said DO of about 4 ppm is necessary to support game fish while the maximum amount the water could hold if completely unpolluted would be around 8 ppm. The discharge limits were set by the EPA before the DNR was given the responsibility of controlling discharges into state waters. The standards for the Kraft Division were once lower but were revised upward by the EPA in a process that began before the DNR took over, Williams said. Consolidated is constructing a joint treatment facility for its Kraft, Wisconsin Rapids and Biron Division mills scheduled for completion September of I 1975.
