to 9 p.m. In lieu of flowers donations to the charity of your choice would be greatly 'firetrap' The City of Verdun has won a Superior Court injunction to force the owners of a "rat-infested fire hazard" shed behind 3969 Ross St. to tear down the building by noon today. But the legal victory is only the beginning of a court battle which may result in the demolition of the dilapidated two-story apartment dwelling and the eviction of Walter Wu-sener and his elderly mother, who have owned the building for about 50 years. "The house should be condemned," Verdun Fire Chief Robert O'Reilly told The Gazette yesterday.

"There is no sanitation, no running water and no toilets. "The house hasn't been touched in 25 years. The stairs are falling down in front and there are no guard rails on the back balcony." O'Reilly said the shed has promoted an infestation of rats and vermin in the area. "It's a deplorable situation for the neighbors." The injunction is the latest development in a lengthy fight by neighbors and three city departments to rectify a situation reported to be against fire, sanitation and safety regulations. If the owners haven't destroyed the shed by noon, the court has ordered the city to remove the small build-ing at Verdun taxpayers' expense.

O'Reilly said the city has been trying to force the Wuseners to improve the buildings for several years through municipal court action. But the younger Wu-sener chose month-long jail sentences instead of paying fines and didn't follow court directives, O'Reilly said. Adjacent neighbors, fed up with the lack of action, threatened to burn the shed down about nine days ago Since then, the city has dispached one of its firemen to stand on guard at the home from 6 p.m. to 6 a.m. each day the source of a dispute simmering between the city and the firemen's union.

"It's a sad case," O'Reilly said. "They (the Wuseners) don't want help. Fining him or putting him behind bars is not the thing to do."
