The first witness was Samuel Miller, who testified in regard to distances the day before, recalled and testified to other distances. Marion was the next, and testified as to the location of hU ranch, the value of the cattle and the circumstances attending the pursuit of them. He said he arrived at Modesto on tho evening of October 1878. He went to Walden'a ratch the next evening, and returned to Jlodaeto early the next morning-, bringing the cattlo with him. Last evening Coroner Clark concluded the inquest en the remains of Antonio Aenilar, who died from the effects of the wound received on Saturday from a knife in the hands of Ybarra. Domingo Arans and Telesfro Castro were oa the wharf at the time the stabbing tock place, and testified in substance the same as first witness.

Bernardino Macais that the knife in the cutting affray waa borrowed from and identified tho knife found under tee woodshed by Solo as the one he lomed to Ybirra. The witness was then taken to the police station and identified the prisoner 23 the man to whom he loaned kuife. Chief Karcher waa called and testified as to certain conversations held with the md produced tho statement which the piisoatr mada in the presence of several a of which was published in tha Record Union yesterday. W. 11. Baldwin made a post-mortem of the body of the deceased, and certified that the cause of his death was from t'm effects of an incised wound received in tha abdomen, the instrument penetrating the lower portion of the stomach. The sessions of both houses of the Legislature I were ibort yesterday, and no important busicess was transacted in either boose. The fi cs were cleared up in both Senate and Assembly, and they I adjourned to give the committees an opportunity to cut out more work for them. The Senate met at 10 o'clock a. President pro tern. TVolfskill, from the Committee on Agriculture, I reported back adversely the bill panting a reward of $30,000 to any person inventing a successful steam engine for me on public highways. The Committee on Printing reported back favorably A. B. 151, making appropriations for the support of tie State printing office. B. 82, to pay the salary of the reporter of decisions of the Supreme Court. Senator Whitney was added to the Committeo on McClure introduced an Act dividing the State into Senatorial and Assembly Districts. It is substantially the same as McClure's A. 15.

1 of the special cession of the Legislature, and differs radically from the Democratic apportionment bills introduced I at this session. Kelloeg introduced for Del Valle two fee bills. Filchtr introduced an Act to add a new section to the Penal Code, to be numbered Section SS4, to read as follows "If it appears to the Magistrate that an effenae has been committed of which Justices or Police Court has jurisdiction, he shall, instead of the order provided for in Section make an order that a complaint be filed in the proper Court for the trial of such offense, and must commit the defendant for a reasonable time to await a warrant on such complaint." Vrooman offered an important amendment to Section -204 of the Code of Civil Procedure, relative to the method of selecting and returning of jurors. The law at present requires that the Cuuit make an order for the drawing of jurors at a meeting of the Board of Supervisors in January of each year. It is claimed that there are two objections to this.

In the first place the roll is made up aud completed lii August. The jurors are rot selected until January, therefore by the tune their names are called any do not appear on' the new roil and they are disqualified. la the next place, in several of the counties the Board of Supervisors do not meet until February. The amendment proposed is to have the Jurors drawn in September. S.

The bills making appropriations for deficiencies in the appropriation for transportation of prisoners and Insane for the 32d andSSd naealyean were read third time and passed. Pending the first reading of the horticultural bill it found that there was no quorum, there being only nineteen Senators present. A call of the Senate was ordered, but as several inator carte in during tho roil call further proceedings under the call were dispensed with. Tho Senate took a recess until 2 r. M.

When the Senate reassembled, the special order of the hour was taken up, being Hectare's proposed amendment to Section 19 of Article XI. Un motion of Mr. McCiure it was made the special order fur Tuesday next, at 2 o'clock P. 8. B.

83, amending the Bank Commissioner Act, was reported back favorably by the Committee on Corporations, taken up out of order, under a suspension of the rule, and read the first time. FUeber introduced a resolution providing for the appointment of a inxmittee of three to ascertain what committees have clerks and what clerks are needed. Ho did not think all the committees needed clerks. Kellogg, Cross and Kelly n' S. lino opposed the resolution.
