M. Young of Fredericton, one of seven men charged in connection with theft of materials and scrap from the Petawawa military camp, was excused this afternoon until Monday. This was ordered by Judge A. G. McDougall so he and counsel can discuss the admissibility of evidence.

Young's trial opened Tuesday. Also charged are Jack Jacobson, manager of the Jacobson Iron and Steel Company in Brockville, his employees Amos Durant and David C. Mawhinney; Morris and Harry Eisen of Pembroke, and Capt. Donald W. Baldock of Brandon.

Before the jury was dismissed, Constable I. K. Tavlor of the R.C.M.P. told the court he executed two search warrants at Jacobson's company March 7 last. He seized five cement block pressers.

fonr space heaters, two metal shower stalls, three 45-gallon steel drums and two box stoves. He also discovered approximately 514 additional heaters, 70 more shower stalls, space, 45-gallon drums, 119 kitchen ranges and 59 box stoves. The constable said he thought most of the items were serviceable. James G. Chartrand, a civilian truck driver, told of loading about tons of stoves and other articles and hauling them to the C.P.R.

siding at Petawawa last fall, He also removed one truckload to' the Pembroke Salvage the Company C.P.R. and yards an- in Pembroke. He said Young supervised all the operations. Gerald V. Whelan, who worked on the scrap removal project, said he worked under Young.

It was his job to dismantle some old stoves and equipment and load them on trucks which carried the Jacobson Steel Company name. Evidence that Young had borrowed 8 crane from No. 3 stores and equipment depot at Petawawa several times last year was given by Sgt. Stanley Fiset, the N.C.O, in charge. Staff Sgt.

Ross A. Pugh of the Corps Commissionaires at the camp, Identified a letter sent to him by Capt. Baldock in which he was instructed to keep a tally of all the Jacobson trucks leaving the camp with loads. He said the tally was made so that the number of trucks could be checked against weight slips from the Pembroke market weigh scale. On one occasion he had refused to permit one of the trucks to leave the camp because its contents metal boiler, a galvanized iron sink and some other items not look like scrap to me." He reported the incident to Young who told him not to let the load through.

Witness said on another occasion he saw a number of serviceable son Company truck. Under crossstoves being loaded onto a A Jacobexamination Pugh said he did not know where the stoves were taken. Its full strength is 70. Cardinal Faulhaber was the last surviving cardinal created by Pope Benedict XV. He received the red hat in 1921. During the Nazi regime in Germany Cardinal Faulhaber constantly attacked the authorities for restricting religious freedom and persecuting Jews. Police did not interfere when in November, 1938.

a crowd stoned the cardinal's residence after demolishing and looting Jewish shops in Munich. After Hitler Germany collapsed he was in the forefront of an appeal to the world for an understanding with the defeated German people and for aid for the victims of war.
