The defendant had Judge Zieg-ler and J. H. Keith of Coffey villc and Clark Brown of this city. The first witness for the State called this morning was Undertaker Skinner of the Coffey ville Furniture Company, who took care of the b'ody of the deceased and who was an eye witness of the tragedy. The clothing worn by Morris when he was killed was introduced in evidence, to show the bullet holes, etc.

The witness brought the clothing with him in a telescope. The direct of the State's witnesses was not materially changed upon cross-examination. None of this testimony showed that Morris was armed, but on the contrary, indicated that Nelson was the aggressor. The defense, when it gets to work, however, may be able to make a very strong case. No attempt' was made by Nelsons lawyers to introduce any testimony in his favor at this hearing.
